Accordingly, the implementation of removing difficulties in granting certificates of land use rights, house ownership rights and other assets attached to land (land and house certificates) will start from May 2023, with a total of 81,085 houses in 335 eligible commercial housing projects but have not been granted land and house certificates. The Department of Natural Resources and Environment (DONRE) of Ho Chi Minh City has divided the problems into 6 groups to resolve.

After 4 months of implementing this plan, 3,812 applications for land and house certificates have been resolved, reaching a rate of 4.7%. There are still more than 77,200 other applications in different groups.

Specifically, for the group of 30,896 houses that have not been granted land and house ownership certificates due to investors being late in submitting application documents, up to now, 6,895 cases have submitted documents.

A group of 19,958 houses in 39 projects have not been resolved due to additional financial obligations. Of which, more than 8,000 houses in 19 projects are subject to legal review.

Ho Chi Minh City is stepping up efforts to resolve problems in granting land and house ownership certificates for many projects.

A group of 8,159 files at 47 projects have not yet been granted land and house certificates because they are waiting for confirmation of completion of financial obligations. The reason for the delay is that the physical facilities for implementing electronic tax connection between the land registration agency and the tax agency are not yet guaranteed.

The group of 4,653 houses in 6 projects that have not been granted land and house certificates due to other problems have been classified according to the responsibility of each agency.

Of the 8,235 houses in 18 projects that have not yet been granted land use certificates due to inspection, examination and investigation, 2 projects are under the jurisdiction of Working Group 153, the remaining 5 projects have temporarily paid land use fees and 11 projects are being inspected and investigated by competent authorities.

Especially with the group of 10,019 houses in 29 projects that have not been granted land and house certificates due to problems with new types of real estate that have not been regulated in legal documents. This group has not yet been resolved for any project.

The Department of Natural Resources and Environment said that although there were no problems, it was still waiting for guidance from the Ministry of Natural Resources and Environment on determining additional financial obligations, if any, for projects in this group.

In the coming time, the Department of Natural Resources and Environment said it will implement more solutions to continue to remove difficulties and speed up the process of handling applications for granting land and house certificates.

Previously, in the report on the results of implementing tasks in the field of land, compensation, support, and resettlement in Ho Chi Minh City in the first 9 months of 2023, the Department of Natural Resources and Environment said that it had issued a total of 5,480 first-time certificates to organizations and individuals.

Of these, the land certificates issued to individuals accounted for the majority, with 5,436 certificates. Only 44 land certificates were issued to organizations. In addition, the authorities have processed registration procedures for changes in 234,527 land certificates.

According to the Department of Natural Resources and Environment of Ho Chi Minh City, compared to the same period in 2022, the rate of processing applications for granting land certificates, registration of changes and registration of secured transactions decreased by an average of 36.4%. In particular, the rate of processing applications for all types in the third quarter of 2023 increased by 6% compared to the same period last year.
