Why has the Land Law not been amended as planned?

(Dan Tri) - According to Ms. Pham Thi Hong Yen, the reason why the Land Law has not been amended at the 10th session is because more time is needed to fully assess the difficulties and problems; at the same time, ensuring that the amendment must be comprehensive and fundamental.

At the press conference on the afternoon of October 17, Ms. Pham Thi Hong Yen, a full-time National Assembly delegate of the Economic and Financial Committee, answered the question about why the National Assembly has not yet amended the Land Law as planned.

The Land Law 2024 has been promulgated and will take effect from August 1, 2024. According to Ms. Yen, this is a major and extremely important law, directly and deeply affecting all socio-economic activities, affecting businesses and people.

Many new contents of the law and the system of documents detailing the Land Law, according to Ms. Yen's assessment, have been groundbreaking.

However, from 2024 to now, the world economic context has been very unpredictable. Vietnam is focusing on prioritizing growth, stabilizing the macro economy and implementing a revolution in streamlining the apparatus and building a two-tier local government model.

“These are new contexts, requiring solutions to immediately remove shortcomings in order to adapt,” said Ms. Yen.

The reason for not amending the Land Law immediately, Ms. Yen explained, is that comprehensively amending the law at this time needs more time to fully assess the difficulties and obstacles. At the same time, it is necessary to ensure that the amendment solutions must be comprehensive, fundamental, comprehensive, synchronous and interconnected; and comply with the principle of harmonizing the interests between the State, people and businesses.

Therefore, the comprehensive amendment of the Land Law will continue to be studied in the coming time.

Instead, the immediate solution is to issue a Resolution to immediately remove obstacles in the current context.

This content is being further studied by the Government and National Assembly agencies to report to the National Assembly Standing Committee and the National Assembly.

“This solution is expected to contribute to achieving socio-economic development goals, improving land management efficiency and creating momentum for Vietnam to become a high-income developed country,” said Ms. Yen.

Sharing about the change in the discussion method at the 10th session when combining related contents, Vice Chairman of the Committee on Law and Justice Nguyen Manh Cuong said that combining laws and reports with related contents into the same discussion session does have limitations, but this is the optimal and most feasible solution to complete the unprecedented massive amount of work at the 10th session.

He said that at this session, the National Assembly considered and approved 53 draft laws and resolutions.

With many urgent issues raised, along with the grouping of many discussion topics, according to Mr. Cuong, we should not chase quantity but still put the requirement of ensuring the quality of the draft laws first.

Mr. Cuong emphasized many solutions, including innovation in legislative thinking. The National Assembly only stipulates framework examples and principles within its authority, while anything that fluctuates is left to the Government to regulate.

The National Assembly Party Committee also regularly coordinates with the Government Party Committee and relevant agencies to improve the work of submitting, examining, receiving and revising draft laws; and removing difficulties and obstacles in the law.

Along with that, according to Mr. Cuong, the management of group and hall discussions must also ensure flexibility, focus on large, important issues, and avoid duplication.
