North-South Expressway through Quang Tri still has land clearance problems

According to Giao Thong Newspaper reporters in late May, along the Van Ninh - Cam Lo highway through Vinh Linh and Gio Linh districts ( Quang Tri ), people are urgently dismantling their houses to hand over the land.

However, there are still many trees that have not been cut down, and many houses have not been demolished. It is worth mentioning that there are sections where the land has been handed over but people are blocking the construction.

People stood in front of the bulldozer, preventing the contractor from continuing construction on the 300m section south of Rao Truong bridge.

Mr. Nguyen Anh Tuan - Vice Chairman of Vinh Linh District People's Committee said that by the end of May, the site clearance work in Vinh Linh district was still stuck for about 800m, of which the biggest problem was the 250m section through the Quang Tri Forestry Products Joint Stock Company factory. Relocating the company's factory was very difficult because it had not yet been granted an investment policy for the new location.

According to Mr. Tuan, Vinh Linh district is continuing to make efforts to be able to hand over the site as soon as possible in June.

In Gio Linh district, 3 houses built on public land in Linh Truong commune and many houses in Linh Truong and Gio An communes have not yet been demolished.

Gio Linh District People's Committee said that it has cleared 11,336/11.7km, reaching 96.89%.

The remaining 364m without land clearance are related to 10 households that have not received money in Gio An and Linh Truong communes; 3 cases of house construction on public land, the district is implementing support when the State reclaims land to implement the project according to regulations.

Trouble from a household

According to Giao Thong Newspaper, on May 28, Vinh Linh district authorities sent officials to support the contractor in constructing the 300m section of the local site that was handed over south of Rao Truong bridge.

However, after only a little bit of weathering, this 300m section "stopped" because the people did not allow construction, and no local forces were present here anymore.

According to Mr. Le Anh Tuan, Vice Chairman of Vinh Linh District People's Committee, the district has developed a construction protection plan but has not yet implemented it "because it would be too ostentatious". On the morning of May 28, the government and functional forces went to "mobilize, propagate, and persuade to ensure security and order for the construction unit".

The 300m section south of Rao Truong bridge, which has just been weathered a little, has to stop because Ms. Tuy does not allow the contractor to continue construction.

"The district has developed a plan, will coordinate with the construction unit, and has a construction protection plan, expected to be implemented in early June," said Mr. Tuan.

It is known that this 300m section belongs to the household of Mr. Nguyen Van Long and Mrs. Hoang Thi Tuy. According to this household, the two have agreed on the land area and compensation and support funds (more than 5.2 billion VND). However, the two have not agreed on how to receive this compensation and support funds. Mrs. Tuy and Mr. Long are also waiting for the court to judge their divorce and divide the couple's common property during the marriage.

According to Ms. Tuy, the land use right certificate as well as the decision on compensation and support plan are both owned by Mr. Long and Ms. Tuy. Ms. Tuy also submitted a request to pay the above amount to Ms. Tuy 50%, Mr. Long 50%; in case Mr. Long does not agree, the district is requested to transfer the entire above amount to the district State Treasury for temporary holding so that Ms. Tuy and Mr. Long can divide the common property according to the law.

However, the district has now paid the entire amount into Mr. Long’s account, but he has not transferred the money to Ms. Tuy. Therefore, Ms. Tuy has not yet allowed the construction of this 300m section to… claim her rights.

The last section of the road that has been blocked by land clearance through Cam Lo district and has just been opened is being raced by the contractor to meet the progress.

According to Mr. Le Anh Tuan, in this case, Mr. Long requested to transfer all the money to Mr. Long. Ms. Tuy submitted a request to the district requesting to receive 50% of the money. This lasted from March 2023 until near Tet.

The District Land Acquisition Council invited Mr. Long and Ms. Tuy to come back to receive the money many times but could not resolve the issue. Mr. Long filed a petition, reflecting that the District Land Acquisition Council did not pay the money.

The District Land Acquisition Council has reported and the District Land Acquisition Steering Committee has organized a meeting inviting the judiciary, court, and district inspectors to participate. At the meeting, there were different opinions on the payment of the above amount. Some opinions suggested transferring the above amount to a temporary account to protect the construction, some opinions said to pay Mr. Long 50% and Mrs. Tuy 50%, some opinions said to pay the homeowner.

Meanwhile, Mr. Long and Ms. Tuy did not have a dispute over the land use rights that had been recovered, so in order to promptly carry out land clearance and compensation, on January 23, 2024, the District Land Clearance and Compensation Council paid the entire compensation and support costs mentioned above to the household into an account owned by the head of the household, Mr. Long.

To the north of these houses being demolished in Linh Truong commune, Gio Linh district, there are still many houses that have not been demolished.

According to Mr. Tuan, the District People's Committee does not have the authority to divide the property when Ms. Tuy requested to pay 50%. The division of compensation and support between Mr. Long and Ms. Tuy is not under the jurisdiction of the District People's Committee. In case Mr. Long and Ms. Tuy cannot reach an agreement on the division of the above property, they can submit a request to the court to divide the common property.

As for the option of transferring money into a temporary account, Mr. Long and Ms. Tuy's case only has a dispute about who receives the money and how, so it does not fall under this category.
