Investors bidding for social housing have new regulations

Circular 03/2023/TT-BXD amends and supplements Point d, Clause 1, Article 3 on principles for selecting investors in social housing construction investment projects by bidding.

Accordingly, social housing construction investment projects must select investors through bidding and must meet the conditions prescribed in Clauses 2, 3, 5 and 6, Article 11 of Decree No. 25/2020/ND-CP of the Government detailing the implementation of a number of articles of the Law on Bidding on investor selection and the following conditions:

Firstly, do not use the capital source specified in Clause 1, Article 53 of the Housing Law to invest in construction works;

Second, not falling under the cases specified in points c and d, clause 2, Article 57 of the Housing Law;

Third, there has been a Decision approving the project investment policy in accordance with the provisions of the law on investment;

Fourth, there is a detailed construction plan approved by a competent authority in accordance with the provisions of law.

In case there is no approved detailed construction plan, it must be in an area with approved zoning plan for areas requiring zoning plan, or with approved general plan for areas not requiring zoning plan.

At the same time, the land planned to implement the housing project must have its detailed planning approved by the competent authority based on the National Technical Regulations on construction planning, technical infrastructure conditions, and social infrastructure of the area to specify the planning land use indicators and related requirements on connecting social infrastructure and technical infrastructure.
