Announcing the decision on amnesty in 2025 (phase 2) on the occasion of National Day September 2

Implementing the lenient and humane policy of the Party and State and the humane tradition of the nation towards criminals sentenced to prison, encouraging them to strive to study, train and progress to become useful people for society, President Luong Cuong has just signed Decision No. 1244/QD-CTN on amnesty in 2025 (phase 2).

On the afternoon of July 7, in Hanoi, the Office of the President coordinated with the Ministry of Public Security , the Supreme People's Court, the Ministry of Foreign Affairs and relevant agencies to hold a press conference to announce the Decision on amnesty in 2025 (phase 2) of the President of the Socialist Republic of Vietnam.

At the press conference, Deputy Head of the Office of the President Pham Thanh Ha said: On the occasion of the 80th anniversary of the National Day of the Socialist Republic of Vietnam (September 2, 2025), President Luong Cuong signed Decision No. 1244/QD-CTN on amnesty in 2025 (phase 2) for people sentenced to fixed-term imprisonment, life imprisonment, and the time served in prison for amnesty consideration is calculated up to August 31, 2025.

Those who are pardoned and not pardoned

The subjects of amnesty include those serving fixed-term prison sentences, those sentenced to life imprisonment that have been reduced to fixed-term prison sentences, and those whose prison sentences are temporarily suspended.

The conditions for being proposed for amnesty are that those who are serving a fixed-term prison sentence, those sentenced to life imprisonment that has been reduced to a fixed-term prison sentence and are proposed for amnesty must meet all the following conditions: Having made much progress, having a good sense of reform, and being classified as having served their prison sentence fairly or well according to the provisions of the law on the execution of criminal sentences.

Specifically: A person sentenced to life imprisonment that has been reduced to a fixed-term imprisonment must have 18 consecutive quarters immediately preceding the time of consideration and request for amnesty classified as good or better; a person sentenced to imprisonment from 15 years to 30 years must have 16 consecutive quarters immediately preceding the time of consideration and request for amnesty classified as good or better;

A person sentenced to imprisonment from 10 years to 15 years must have 14 consecutive quarters immediately preceding the time of consideration and proposal for amnesty classified as good or better; a person sentenced to imprisonment from 8 years to 10 years must have 8 consecutive quarters immediately preceding the time of consideration and proposal for amnesty classified as good or better;

A person sentenced to imprisonment from 5 years to 8 years must have 4 consecutive quarters immediately preceding the time of consideration and request for amnesty classified as good or better; a person sentenced to imprisonment from 3 years to 5 years must have 2 consecutive quarters immediately preceding the time of consideration and request for amnesty classified as good or better; a person sentenced to imprisonment from 3 years or less must have at least 1 consecutive quarter immediately preceding the time of consideration and request for amnesty classified as good or better...

All of the above cases must have a follow-up period to be reviewed and evaluated for results of prison sentence execution classification from good or better.

The Deputy Head of the Office of the President said: Decision No. 1244/2025/QD-CTN also clearly stipulates cases that are not eligible for amnesty.

Accordingly, a person who meets the conditions specified in this Decision shall not be proposed for amnesty if he/she falls into one of the following cases: Being sentenced to imprisonment for the crime of treason; crime of activities aimed at overthrowing the people's government; crime of espionage; crime of violating territorial security; crime of rioting; crime of terrorism aimed at opposing the people's government; crime of sabotaging material and technical facilities of the Socialist Republic of Vietnam;

Crime of making, storing, disseminating or propagating information, documents and items aimed at opposing the Socialist Republic of Vietnam; crime of disrupting security; crime of destroying detention facilities; crime of terrorism or one of the crimes specified in the Chapter on crimes of undermining peace, crimes against humanity and war crimes of the Penal Code;

The judgment, part of the judgment or decision of the Court against that person is being protested under the procedure of cassation or retrial in the direction of increasing criminal liability; is being prosecuted for criminal liability for another crime; has been previously granted amnesty; has 2 or more previous convictions; committed the crime of murdering 2 or more people or murder in an organized, hooligan manner; raped children; bought and sold 2 or more people; bought and sold, swapped children under 16 years old; resisted a person on duty causing serious consequences, organized or incited, enticed, or incited others to commit crimes;

There is evidence to confirm that one has illegally used drugs; masterminded, led, or commanded an organized crime case; committed a crime of a professional nature; been sentenced to imprisonment for 3 or more crimes...

New points in the amnesty period September 2

On behalf of the Standing Advisory Agency for Amnesty, Senior Lieutenant General Le Van Tuyen, Deputy Minister of Public Security, answered reporters' questions. Amnesty is a special lenient policy of the State on the occasion of important events, major national holidays or in other special cases.

In recent years, the Party and State have organized many amnesties, including two amnesties in one year in 2009 and 2011.

Informing about some new points in Decision No. 1244/2025/QD-CTN, Senior Lieutenant General Le Van Tuyen said: Compared with Decision No. 266/2025/QD-CTN on amnesty in 2025 on the occasion of the 50th anniversary of the Liberation of the South and National Reunification Day (April 30), in Decision No. 1244, the amnesty subjects continue to be expanded.

Specifically, there are 4 groups of criminals whose conditions are relaxed, such as: Groups of criminals who intentionally cause injury, resist public officials, and rob property multiple times or more; groups sentenced to prison for committing 2 or more intentional crimes, including cases of combined sentences; groups of subjects with 1 criminal record who are convicted of intentional crimes; groups of subjects who commit murder, robbery, extortion, fraud, kidnapping to appropriate property; resist public officials, human trafficking, trafficking in women, consuming property owned by others, borrowing at high interest rates in civil transactions; immigration brokerage...

Regarding the classification and evaluation of emulation, the Deputy Minister of Public Security said that this amnesty has a more extended evaluation period. Regarding the regulation that when amnesty is granted, it does not adversely affect security and order. After the meeting results of the Council for consideration and recommendation of amnesty, the prisons and detention camps send the list of prisoners eligible for amnesty to the Standing Office of the Amnesty Advisory Council for synthesis and request the local police to verify factors affecting security and order.

Based on the verification results of the local police, the Standing Office of the Amnesty Advisory Council synthesizes and proposes to the Amnesty Advisory Council for consideration and decision at the Amnesty Advisory Council meeting.
