Prosecutor Jack Smith asks to reinstate Trump's classified documents case

Special prosecutor Jack Smith asked a federal appeals court on August 26 to reinstate the criminal case accusing Donald Trump of keeping classified documents, after a judge dismissed the indictment in July.

On July 15, Judge Aileen Cannon in Florida ruled that special prosecutor Jack Smith, who prosecuted former US President Donald Trump in the case of keeping classified documents, was illegally appointed.

In an Aug. 26 brief, prosecutor Jack Smith and his team urged the Atlanta-based 11th U.S. Circuit Court of Appeals to overturn Judge Cannon's ruling.

" Congress has given the attorney general broad authority to organize the agency he leads to carry out the responsibilities required by law.

The district court's contrary view contradicts an uninterrupted process of decision-making, including the Supreme Court, that the attorney general has such authority, and it is inconsistent with widespread and long-standing appointment practices in the Justice Department and in the Government," the brief said.

Mr. Smith's office also asked the appeals court to schedule arguments.

The US Justice Department previously announced plans to appeal Judge Cannon's ruling.

Also on August 26, Mr. Trump's campaign said the court should reject prosecutor Jack Smith's request. The campaign also said the court should dismiss other cases Mr. Trump faces, calling them a "witch hunt."

The July 15 ruling is seen as a major victory for Mr. Trump, as he attempts to run for the White House.

On July 1, the Supreme Court ruled that Mr. Trump enjoys immunity from prosecution for all actions within his constitutional authority as president.

The Supreme Court's ruling has led to a delay in a second criminal case led by special counsel Jack Smith, in which Mr Trump faces charges of attempting to overturn the results of the 2020 presidential election.

At the same time, the sentencing of Mr. Trump in the case of falsifying business records to hide the payment of "hush money" to a porn star was also postponed.

In the classified documents case, Mr. Trump was indicted on charges of knowingly retaining sensitive national security documents at his Mar-a-Lago estate in Florida after leaving office in 2021 and obstructing the government ’s efforts to recover the documents.
