Proposed structure of ward chairman and vice chairmen
According to the draft, the proposed organizational structure of the People's Committee of wards in Hanoi is specifically as follows: wards of type 1 and wards of type 2 have a chairman, 2 vice chairmen, and 6 civil servant positions; wards of type 3 have a chairman, 1 vice chairman, and 6 civil servant positions. 6 civil servant positions working at the People's Committee of wards of the city are prescribed in Clause 3, Article 61 of the Law on Cadres and Civil Servants 2008 (amended and supplemented in 2019).
The Hanoi People's Committee shall base on the number of ward administrative units (AUs) with population size and natural area larger than the standards prescribed in the Resolution of the National Assembly Standing Committee on standards of AUs and classification of AUs to calculate the additional number of other civil servants working at the Ward People's Committee.
Specifically, for every 1/3 increase in population size, the ward will be allowed to add 1 civil servant. In addition to the provisions in Point a, Clause 2, Article 4, for every 100% increase in natural area, the ward will be allowed to add 1 civil servant.
Regarding the activities of the People's Committee and the Chairman of the Ward People's Committee, the draft clearly states that the Ward People's Committee operates under the head regime, ensuring the principle of democratic centralism. The Ward Chairman must dialogue with the people at least twice a year.
At least twice a year, before the regular meeting of the People's Council of the district, town, or city, the Chairman of the Ward People's Committee is responsible for organizing a dialogue conference with the People in the ward on issues related to the rights and legitimate aspirations of local citizens.
At the same time, the Chairman of the Ward People's Committee organizes a meeting to collectively discuss issues within the functions and tasks of the Ward People's Committee. When the content of the Ward People's Committee meeting includes related issues, the Chairman of the Ward People's Committee invites representatives of relevant professional agencies of the District, Town, and City People's Committees. At the same time, the Party Secretary, Chairman of the Vietnam Fatherland Front Committee, Head of the Social-Cultural Organization, Ward Police Chief, Party Cell Secretary, and Head of the Residential Group attend the meeting of the Ward People's Committee.
The People's Committee and the Chairman of the People's Committee of the ward are under the supervision of the People's Council of the district, town, or city in the performance of their assigned duties and powers. The Chairman of the People's Committee of the ward is under the direct leadership and direction of the People's Committee and the Chairman of the People's Committee of the district, town, or city in the city.
Regulations on responsibility and recruitment of ward civil servants
At the same time, the responsibility regime of the chairman, vice chairman and other civil servants working at the ward People's Committee is also specifically regulated. The chairman of the ward People's Committee is the head of the ward People's Committee; responsible to the People's Council, People's Committee, chairman of the People's Committee of the district, town, city under the city and before the law for the performance of the duties and powers of the ward People's Committee.
The Vice Chairman of the Ward People's Committee assists the Chairman of the Ward People's Committee in handling tasks assigned by the Chairman of the Ward People's Committee, and is responsible to the Chairman of the Ward People's Committee and before the law for the performance of assigned tasks.
Other civil servants of the Ward People's Committee are responsible to the Chairman of the Ward People's Committee and Vice Chairman of the Ward People's Committee in charge of performing professional tasks assigned by the Chairman of the Ward People's Committee in accordance with legal regulations.
Regarding the recruitment and use of civil servants working at the Ward People's Committee, the draft stipulates that civil servants working at the Ward People's Committee are part of the civil servant staff of the District, Town, and City People's Committee. The Chairman of the District, Town, and City People's Committee shall recruit civil servants to work at the Ward People's Committee.
At the same time, regarding the use and management of civil servants working at the Ward People's Committee, the Chairman of the Ward People's Committee directly uses and manages civil servants working at the Ward People's Committee.
Regarding the term of office of Chairman and Vice Chairman of the Ward People's Committee, the draft clearly states that the term of office of Chairman and Vice Chairman of the Ward People's Committee for each appointment is 5 years, calculated from the effective date of the appointment decision. The Chairman of the Ward People's Committee shall not hold office for more than 10 consecutive years at the same ward administrative unit.
The Chairman and Vice Chairman of the Ward People's Committee are entitled to a leadership position allowance equivalent to the allowance of the head and deputy head of a specialized department of the People's Committee of a district, town, or city.
