Proposal to regulate the authority to recruit teachers

The Ministry of Education and Training (MOET) is drafting a Circular regulating the authority to recruit teachers.

The Department of Education and Training is in charge of organizing the recruitment of teachers for preschools, primary schools , secondary schools, and multi-level general schools, with the highest level being secondary school. (Source: VGP)

This draft Circular stipulates the authority to recruit teachers in public educational institutions and guides the determination of educational institutions qualified to recruit teachers.

According to the draft, the Department of Education and Training will take the lead in organizing the recruitment of teachers in preschools, primary schools, junior high schools, and general schools with multiple levels of education, with the highest level being junior high school.

In case the Chairman of the Provincial People's Committee decentralizes the recruitment of teachers in preschools, primary schools, secondary schools, and general schools with multiple levels of education with the highest level being secondary school to other agencies or units, the decentralization shall be implemented by the Department of Education and Training.

If decentralized to educational institutions, educational institutions must meet the conditions for recruiting teachers according to regulations.

Authority to recruit teachers in high schools, general schools with many levels of education with the highest level being high school, specialized schools, and continuing education facilities

The draft clearly states that the Department of Education and Training shall take the lead in organizing the recruitment of teachers in high schools, general schools with many levels of education with the highest level being high school, specialized schools, and continuing education facilities.

The principal of a high school, a general school with multiple levels of education with the highest level being a high school, a specialized school; or the director of a continuing education institution shall recruit teachers if the educational institution meets the conditions for recruiting teachers according to regulations and is delegated the recruitment by the Chairman of the Provincial People's Committee. The delegation of recruitment is chaired and advised by the Department of Education and Training.

Authority to recruit teachers in other educational institutions

1- For preparatory colleges: The principal of the preparatory college recruits teachers under his/her management authority.

2- For schools of state agencies and political organizations: The head of the educational institution shall recruit teachers under his/her management authority.

3- For educational institutions under the management authority of the Provincial People's Committee, except for educational institutions specified in Point a, Point b, Point c, Clause 2, Article 14 of the Law on Teachers; Article 3, Article 4 of this Circular and for preparatory schools, schools of state agencies, and political organizations: The Department of Education and Training shall preside over the organization of recruitment of teachers in educational institutions specified in Clause 3 of this Circular.

The head of the educational institution specified in Clause 3 above shall recruit teachers if the educational institution meets the conditions for recruiting teachers according to regulations and is delegated the recruitment by the Chairman of the Provincial People's Committee. This recruitment delegation is chaired and advised by the Department of Education and Training.
