At the seminar to contribute opinions on the draft Law amending and supplementing a number of articles of the Law on Education and the Law on Higher Education (amended), Ms. Mai Thi Anh, Director of the Legal Department (Ministry of Education and Training) said that this is to concretize a number of contents of Resolution 71 of the Politburo on breakthroughs in education and training development.
Specifically, the resolution requires not to organize school councils in public educational institutions (except for public schools with international agreements); and to have the Party Committee Secretary concurrently be the head of the educational institution.
Therefore, the university council and the public school council are no longer mentioned in the draft of these two amended laws. This means that the school council will cease to operate when the law is passed and takes effect. The expected time for the cessation of the public school council is January 1, 2026.
The draft Law amending and supplementing a number of articles of the Law on Education and the Law on Higher Education only stipulates the organization of school councils at private institutions or schools established under the Government 's agreement.

According to Ms. Mai Thi Anh, some delegates suggested that the school council should be terminated before the above-mentioned time so that units can have a roadmap to complete their organizational structure and facilities in time before the new year. The drafting team of the Ministry of Education and Training will study this.
The representative of the Legal Department (Ministry of Education and Training) also asked the delegates to give their opinions on "when the school council ends, who will be responsible for transferring the tasks to?"
According to the draft revised Law on Higher Education, when operations cease, documents issued by university councils and school boards will continue to be applied until a decision is made to abolish or replace them, but not more than 12 months.
The Ministry of Education and Training said that in 2024-2025, according to reports from ministries, branches and localities, 173 public higher education institutions (excluding military and police institutions) have established school councils.
The university council is a part of the organizational structure of a higher education institution. It is an administrative organization that exercises the representative rights of the owners and interested parties. The university council of a private university or a private university operating not for profit is an administrative organization that represents investors and interested parties.
Currently, the country has 11 universities, 173 public colleges and academies; 67 private universities and foreign-invested institutions.
