
In his opening speech at the workshop, Vice Chairman of the Committee for Science, Technology and Environment Tran Van Khai stated that the 2014 Construction Law has made positive contributions to the management of construction activities over the past decade. However, in the new context and new development requirements, the Law has revealed many limitations and problems. Therefore, comprehensively amending the Construction Law is now an urgent requirement to remove institutional bottlenecks and create new momentum for the construction industry and the economy in general. The goal of comprehensively amending the Construction Law is not only to overcome current shortcomings but, more importantly, to create a new, modern, open and transparent legal framework to free up all resources for investment and development.

According to the report of the Ministry of Construction , this draft Law amends 141/168 articles of the current Law, restructuring into 8 chapters with 96 articles, focusing on 4 major policy groups: innovating management methods, improving management efficiency in construction investment; cutting down and simplifying administrative procedures and investment and business conditions in construction; strongly decentralizing and delegating power in construction management, along with a clear monitoring mechanism and accountability; only regulating in the law issues of a framework and principle nature and assigning the Government to specify in detail technical and professional issues, in the spirit of innovation in legislative thinking.

The Standing Committee of the Science, Technology and Environment Committee recognized that the draft Law has attempted to fully institutionalize the Party's major policies and orientations; the spirit of Resolutions No. 57, 59, 66, 68 of the Politburo has been thoroughly implemented in the draft. In addition, the draft Law still has a number of issues that are still being consulted for completion.

At the workshop, delegates directly commented on practical problems and difficulties such as: the mechanism for managing construction norms and unit prices to ensure cost control in public investment projects while being flexible for private enterprises; the flexible adjustment of investment capital between component projects when the total investment remains unchanged to reduce multi-level approval procedures; the consistency of the draft Law with related laws; the feasibility of new regulations... Many opinions were also contributed to the contents: scope of regulation; explanation of terms; regulations on construction contracts; regulations on the role of investors...

Receiving comments on the draft Law, Deputy Chairman of the Committee for Science, Technology and Environment Tran Van Khai stated that the comments at the workshop will help the drafting agency and the reviewing agency to best complete the draft Law on Construction (amended), meeting the requirements of national development in the new period.
