Urgently complete the draft Resolution of the National Assembly on special policies for the development of urban railways in Hanoi and Ho Chi Minh City.

The Government Office has just issued Document 24/TB-VPCP dated January 21, 2025 announcing the conclusion of Deputy Prime Minister Tran Hong Ha at the meeting on building specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City.

The Ministry of Transport completed the draft Resolution on specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City, and submitted it to the Government on January 25, 2025.

Deputy Prime Minister Tran Hong Ha highly appreciated the efforts of the Ministry of Transport, the People's Committee of Hanoi and the People's Committee of Ho Chi Minh City in preparing the report on the draft Resolution on specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City (Resolution).

According to the Program, the National Assembly will open the 9th extraordinary session on February 12, 2025. The implementation progress is very urgent, so to ensure the progress of submitting to the National Assembly for consideration and approval at the 9th extraordinary session, the Deputy Prime Minister agreed with the opinions of the Ministry of Transport and the Ministry of Justice on reporting to the National Assembly for permission to draft a Resolution according to a shortened order and procedure, and submit it to the National Assembly for approval according to the process of 01 session.

The People's Committee of Hanoi and the People's Committee of Ho Chi Minh City fully absorb the opinions of the Ministry of Planning and Investment and the Ministry of Justice, urgently review the existing policy mechanisms in the Law on the Capital, Resolution No. 98/2023/QH15 dated June 24, 2023, Resolution No. 172/2024/QH15 and update the contents stipulated in the Laws passed by the National Assembly at the 10th session of the 15th National Assembly to fully supplement policies to promote efficiency in the process of investing and exploiting urban railway lines (decentralization, delegation of power to the two cities to proactively organize implementation and take responsibility for the results; shorten the sequence and procedures for investment preparation, project implementation, speed up construction progress; develop underground space, effectively exploit land funds around stations, mobilize capital, develop according to the TOD model...); Submit to the Ministry of Transport no later than January 21, 2025.

The Ministry of Transport urgently presides over and coordinates with the People's Committee of Hanoi City and the People's Committee of Ho Chi Minh City to urgently prepare documents to propose the development of the Resolution and at the same time review and complete the draft Resolution (the Ministry of Transport establishes a Working Group to develop the draft Resolution, consisting of the Ministries of Planning and Investment, Construction, Finance, Justice, Natural Resources and Environment, Science and Technology; Leaders of relevant Departments, branches and sectors of the People's Committee of Hanoi City and the People's Committee of Ho Chi Minh City and invites agencies of the National Assembly; divided into 03 groups, including: the group reviewing general policy mechanisms; the group reviewing policy mechanisms specifically applicable to Hanoi City and the group reviewing policies specifically applicable to Ho Chi Minh City).

The Ministries of Planning and Investment, Construction, Finance, Justice, Natural Resources and Environment, Science and Technology, Hanoi People's Committee and Ho Chi Minh City People's Committee are responsible for assessing the feasibility and effectiveness of each policy; assigning members to the Working Group; closely coordinating with the Ministry of Transport in the process of reviewing and completing the draft Resolution (timely sending comments within the deadline requested by the Ministry of Transport for the Ministry of Transport to complete).

The Ministry of Justice is responsible for guiding the Ministry of Transport on the procedures, processes, and documents to submit to the National Assembly for consideration and approval of the Proposal to develop a Resolution according to the shortened procedure and the draft Resolution of the National Assembly; preside over the appraisal of the Documents according to the provisions of the Law on Promulgation of Legal Documents; submit to the National Assembly for consideration and addition of the Resolution to the 2025 Law and Ordinance Development Program and develop a draft Resolution according to the shortened procedures, submit to the National Assembly for approval according to the process of 01 session (the 9th extraordinary session of the National Assembly).

The Ministry of Transport completes the draft Resolution dossier and submits it to the Government on January 25, 2025.

Regarding the submission progress, the Deputy Prime Minister assigned the Minister of Transport, authorized by the Prime Minister, to send a document to the National Assembly Standing Committee on January 21, 2025 to register the content of the draft Resolution on specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City to the 9th extraordinary session (early February 2025); be responsible for developing a specific Plan and schedule for submitting the Dossier to ensure the schedule as required by the National Assembly Standing Committee and the National Assembly (in which, be responsible for completing the Dossier according to regulations and sending it to the Ministry of Justice on January 23, 2025); closely coordinate with the National Assembly agencies in the process of submitting the Dossier, receiving, explaining the content of the review and submitting it to the National Assembly.

The Ministry of Justice shall complete the appraisal of the dossiers as prescribed on January 24, 2025; submit to the National Assembly for consideration and addition of the draft Resolution to the 2025 Law and Ordinance Development Program and draft the Resolution according to the simplified order and procedures, and submit to the National Assembly for approval according to the 1-session process (before February 3, 2025).

The Ministry of Transport receives and completes the draft Resolution and submits it to the Government on January 25, 2025.
