Prosecute the case and prosecute the defendant against Shark Binh

(Chinhphu.vn) - Hanoi City Police said that on October 10, the City Police Investigation Agency issued a decision to prosecute the case and prosecute Nguyen Hoa Binh and 9 other subjects for the crime of Fraudulent appropriation of property as prescribed in Article 174 of the Penal Code and the crime of Violating accounting regulations causing serious consequences as prescribed in Article 221 of the Penal Code.

On the afternoon of October 14, the Hanoi Police Department held a press conference to inform about the results of the investigation and discovery of a number of typical cases and incidents of the City Police Department in recent times. Among them was the case related to violations that occurred at Nexttech Group Joint Stock Company, of which Mr. Nguyen Hoa Binh (commonly known as Shark Binh) is the Chairman of the Board of Directors.

At the press conference, Hanoi Police said that on October 10, the Hanoi Police Investigation Agency issued a decision to prosecute the case and prosecute Nguyen Hoa Binh and 9 other subjects for the crime of Fraudulent appropriation of property as prescribed in Article 174 of the Penal Code and the crime of Violating accounting regulations causing serious consequences as prescribed in Article 221 of the Penal Code.

The investigation determined that Nexttech Group Joint Stock Company (address: 3rd floor, VTC Online building, No. 18, Tam Trinh street, Tuong Mai ward, Hanoi) is chaired by Nguyen Hoa Binh (born in 1981; residing at: 430 Sunshine City, Ciputra urban area, Phu Thuong ward, Hanoi).

Around May 2021, Nguyen Hoa Binh and a number of other subjects established the "Antex digital currency" project (stored on the Binance e-wallet) with the purpose of: Selling Antex digital currency and calling on investors to buy Antex digital currency to raise capital to build the "Antex digital currency" project and the "VNDT e-wallet" software (used to store VNDT digital currency) in the future (in fact, the subjects have not completed the construction of the VNDT digital currency project).

The subjects agreed to contribute capital to invest in the Antex digital currency project with a total amount of 5 billion VND to implement the project and according to the agreed structure (in which Binh contributed 2 billion VND).

Nguyen Hoa Binh directed the establishment of the legal entity Vietnam Blockchain Technology Services Joint Stock Company. The initial capital contribution was transferred to the Company's account to maintain the operation of the Antex digital currency project, such as paying salaries to employees and technical staff developing the Project, and purchasing servers to provide Internet services for the Project.

During the project development process, the participants promoted, introduced, and developed digital currency projects; in which, the participants had a policy of selling "Antex digital currency" (abbreviated as 100 billion tokens) to the market.

From August 2021 to November 2021, the issuers sold 30% of Antex tokens (called tokens) to about 30,000 investors nationwide. The total amount of money that investors sent for transactions was 4.5 million USDT (USDT is a stable digital currency converted to the equivalent of 4.5 million USD, equivalent to about 117 billion VND).

From November 2021 to December 2021, Nguyen Hoa Binh used his reputation and influence to post information on social networks about the launch of the "Next100 Blockchain" Investment Fund and committed to investing in digital currency projects with a total capital of 50 million USD in 10 years to promote the Antex digital currency and strengthen the confidence of investors, avoiding the situation of dumping Antex coins (causing a decrease in the value of the currency) to withdraw capital from the project.

Although the project was not implemented as planned, Nguyen Hoa Binh and the shareholders of Nexttech company agreed to withdraw money from the total of the Antex Project, transfer it to the e-wallets of some individuals, including Binh, for use, then divide it among themselves, and also transfer it to companies in the Nexttech company ecosystem to use it for purposes other than those committed to investors.

So far, it has been determined that Nguyen Hoa Binh and his co-founders have withdrawn money from 30,000 investors' wallets, appropriating about 117 billion VND from investors.

Continuing to expand the investigation, Hanoi City Police discovered that in 2022, Nguyen Hoa Binh established Nextland Real Estate Trading Joint Stock Company, then assigned Nguyen Thi Thanh Huong, Tran Thi Thuy Van, Nguyen Ha Thuy, and Doan Van Tuan to use two accounting systems to manage the company's financial activities.

Binh directed employees to falsify profits and conceal revenue by lowering contract prices to evade taxes (causing losses and actual revenue was tracked on internal accounting books), causing especially large damage to the State budget.

The case is under investigation and clarification.
