Regulations on new administrative procedures in the field of intellectual property under the management scope of the Ministry of Science and Technology.

In recent times, the legal system on intellectual property in our country has been built, amended and supplemented, thereby creating a basic legal foundation to regulate issues related to the protection and enforcement of intellectual property rights. Currently, in response to the requirements of the increasingly deep and comprehensive international integration process, the legal system on intellectual property needs to continue to be improved to ensure effective implementation of international commitments, promote the application of scientific and technological research results in production and business, contributing to the socio -economic development of the country.

The principles of building the latest administrative procedures today

On December 18, the Ministry of Science and Technology issued Decision 3038/QD-BKHCN promulgating, together with this Decision, newly issued administrative procedures and abolished administrative procedures in the field of intellectual property under the management scope of the Ministry of Science and Technology. Accordingly, 09 central-level administrative procedures were newly issued as prescribed in the Intellectual Property Law No. 50/2005/QH11 dated November 29, 2005, amended and supplemented by Law No. 36/2009/QH12 dated June 19, 2009, Law No. 42/2019/QH14 dated June 14, 2019 and Law No. 07/2022/QH15 dated June 16, 2022.

Abolish 08 central-level administrative procedures in the field of intellectual property under the management scope of the Ministry of Science and Technology

Decree No. 65/2023/ND-CP dated August 23, 2023 of the Government detailing a number of articles and measures to implement the Law on Intellectual Property on industrial property, protection of industrial property rights, rights to plant varieties and state management of intellectual property and Circular No. 23/2023/TT-BKHCN dated November 30, 2023 detailing a number of articles of the Law on Intellectual Property and measures to implement Decree No. 65/2023/ND-CP dated August 23, 2023 of the Government detailing a number of articles and measures to implement the Law on Intellectual Property on industrial property, protection of industrial property rights, rights to plant varieties and state management of intellectual property related to procedures for establishing industrial property rights and ensuring industrial property information. In which, 08 central-level administrative procedures in the field of intellectual property under the management scope of the Ministry of Science and Technology were abolished, which were announced in Decision No. 3675/QD-BKHCN dated December 25, 2017 of the Minister of Science and Technology.
