Regulations on calculating seniority of teachers

My husband's working time is as follows: September 1981 - February 1990: Working in the Vietnam People's Army (Rank: First Lieutenant, salary: 350, seniority allowance 8%). March 1990 - December 2012: Transferred to work at a state agency (title not counted as seniority). From January 2013 to present: Management staff (Principal of Vocational Secondary School). During this time, my brother directly participated in teaching according to regulations.

In January 2013, my brother received a salary of Senior Specialist until 2022 when he was classified as a civil servant in the education sector V.09 (V.07) according to Decree No. 77/2021/ND-CP.

May I ask, from when will my husband be entitled to seniority as a teacher, from January 2013 or from the time he is classified as an education civil servant in 2022? Is my husband's time in the army counted as seniority and what is the percentage of seniority as a teacher? (nhatnguyet***@gmail.com).

The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2020/ND-CP dated August 1, 2021 of the Government . Accordingly, the working time calculated for seniority allowance includes the working time calculated for seniority allowance in the army, police, and cryptography and the working time calculated for seniority in other industries and professions (if any).

From January 2013 to before 2022, although your husband directly participated in teaching at a public educational institution, during this time his salary was classified as a Senior Specialist. Therefore, your husband is not eligible for seniority allowance for teachers during this period.

From 2022, when your husband is appointed to the professional title of education officer, his working time will be counted towards the time to calculate seniority allowance for teachers according to current regulations.

At the time of starting to receive the teacher's seniority allowance, the time serving in the military before transferring to another sector (subject to calculation according to regulations) will be added together with the time working in the education sector to determine the total time used as the basis for calculating the teacher's seniority allowance.
