The act of forging documents or using fake documents has been negatively affecting many social activities. It is worth noting that the awareness of law compliance of a part of the population is still limited, leading to the increasing purchase and use of fake documents, especially on social networks.

According to the assessment of the Provincial People's Committee, recently, the situation of criminal activities in the province has been quite complicated. In particular, the crime of forging and trading fake papers and documents of agencies and organizations is very large in nature and scale with sophisticated and organized methods.

Exposing fake document rings

A typical example is the network that colluded with doctors and medical staff at general clinics in Bien Hoa City to forge documents such as health certificates, medical records, leave certificates to receive social insurance, health insurance... which was busted by Bien Hoa City Police on May 30.

Lawyer HA MANH TUONG (Provincial Bar Association) said: “The crime of forging seals and documents of agencies and organizations; the crime of using fake seals or documents of agencies and organizations is regulated in Article 341 of the Penal Code amended in 2017. This is a combined crime regulated in the same article, including the acts: forging seals and documents; using fake seals and documents or both of the above acts.

This article stipulates that anyone who forges seals, documents or other papers of agencies or organizations or uses forged seals, documents or papers to commit illegal acts shall be fined from 30 to 100 million VND; be subject to non-custodial reform for up to 3 years or be imprisoned from 6 months to 2 years. In addition, this act can be punished with a maximum of 7 years in prison.

Specifically, on May 30, Bien Hoa City Police conducted a search of 6 general clinics and 2 other locations in Bien Hoa City, discovering and seizing many documents related to the acts of forging documents of these facilities. During the search of the above clinics, the police force seized a total of more than 130,000 certificates of leave from work entitled to social insurance; more than 400 health examination certificates with false results, without information of the examinee; 100 boxes of documents, more than 40 computer CPUs and many other related exhibits.

According to the police investigation, the fake document ring was run by LTH (43 years old, residing in Trang Dai Ward) and HTĐ (36 years old, residing in Trang Dai Ward) who connected with a number of doctors who were the owners of clinics and medical staff of these facilities. When people needed to buy documents: health certificates, sick leave certificates to receive insurance, the subjects contacted the medical staff at the clinics to do it. In particular, these facilities also falsified medical records to profit from billions of dong in insurance money.

Regarding this case, up to now, the Investigation Police Agency of Bien Hoa City Police has prosecuted 20 defendants (temporarily detained 18 defendants) to investigate the act of forging documents of agencies and organizations.

Previously, in early January 2023, the Bien Hoa City Police Investigation Agency prosecuted 7 suspects in a ring specializing in the production and trading of fake documents in Dong Nai and Ho Chi Minh City. This ring specializes in counterfeiting documents such as driver's licenses, degrees, and other related documents. Notably, among the types of documents that the subjects counterfeited were citizen identification cards with electronic chips with QR codes. According to the police, the electronic chips on citizen identification cards that the subjects counterfeited cannot store information like real documents.

The use of fake documents to commit illegal acts has been detected and handled by the police.

In June 2023, the Investigation Police Agency of Nhon Trach District Police completed the investigation conclusion and transferred the case file to the People's Procuracy at the same level to propose prosecuting 8 defendants who are workers at a number of companies in the district for the crime of using fake seals and documents of agencies and organizations.

According to the police investigation, from the end of December 2021 to February 2022, these 8 workers bought fake social insurance leave certificates on social networks to be able to quit their jobs without having to pay for attendance, without losing annual leave, and were paid sick leave by the social insurance agency.

Must stop the situation of fake documents

According to the police, the situation of buying and selling fake documents has a significant impact on political security, social order and safety, and negatively impacts many social activities. In addition to the act of forging documents for personal gain, many people use fake documents regardless of personal interests. This behavior must be handled in accordance with the law.

Fake documents were seized by the police in a document forgery ring that occurred in Bien Hoa City and Ho Chi Minh City.

Recently, through the work of grasping the situation at the grassroots level, Bien Hoa City Police have discovered the situation of forging documents to enjoy insurance policies. If not promptly detected and prevented, it will have a negative impact on security and order, causing damage to the state budget through insurance payments. The police force will continue to expand the investigation, clarify the role of subjects related to this behavior for strict handling.

In the coming time, in addition to focusing on reviewing and grasping the situation from the grassroots level; establishing special projects to combat and destroy rings of making or trading fake documents, the police force will focus on promoting propaganda work so that people understand that making, trading, and using fake documents are all violations of the law; and encouraging people to detect, denounce, and fight against this type of crime.

At the conference to review the first 6 months of 2023 of the Provincial Police, Major General Nguyen Sy Quang, Director of the Provincial Police, said that recently, the police of units and localities have increased the intensity of work, resolutely carried out peak periods of attacking and suppressing crimes. Many professional, sophisticated, inter-provincial criminal rings (including rings of fake documents) have been dismantled and uncovered. In addition, many "hot" cases and incidents that have attracted public attention have been promptly investigated and discovered, contributing to maintaining discipline and law.

Also at this conference, Major General Nguyen Sy Quang said that in the coming time, the Provincial Police Department will continue to lead and direct the police of units and localities to fulfill their requirements and tasks, contributing to ensuring security and order in the area. The police of units and localities must proactively identify crimes in each field, route, and area (including crimes of forging documents for profit, fraud, etc.) to proactively propose appropriate solutions.

In the last months of 2023, the Provincial Police will launch a high-point campaign to crack down on all types of crimes to ensure security and order during the 2024 Lunar New Year to prevent the activities of criminal gangs and other violations of the law; strengthen propaganda and mobilize the entire population to actively participate in the movement of All People Protecting National Security, proactively be vigilant against all types of crimes, including crimes of forgery, buying, selling, and using fake documents, contributing to maintaining security and order in the area.
