Good news for 84,000 households in Ho Chi Minh City

Resolving obstacles for projects is not only good news for thousands of customers but also contributes a lot to the budget revenue of Ho Chi Minh City.

The Ho Chi Minh City People's Committee has just issued a document requesting Deputy Prime Minister Tran Hong Ha and the Minister of Agriculture and Environment to resolve a number of problems in the application of Article 63 of Decree 102/2024 (detailing a number of articles of the Land Law).

Article 63 of Decree 102/2024 provides for the application of land valuation methods to the cases specified in Point b, Clause 2, Article 257 of the Land Law.

According to the HCM City People's Committee, in the process of determining specific land prices in the area, there are still nearly 100 records that fall under the application of Article 63. Because the time of determining specific land prices was in the past (before the 2013 Land Law took effect), it is almost impossible to collect old information from the records as a basis for the organization to determine.

To ensure legality, the Ho Chi Minh City People's Committee has also sent a dispatch to Deputy Prime Minister Tran Hong Ha requesting the Ministry of Agriculture and Environment and relevant agencies to amend and supplement Decree 71/2024.

The Ho Chi Minh City People's Committee proposed to amend and supplement Article 63 to promptly remove difficulties, unblock land resources, and reduce obstacles for people and businesses.

Specifically, for cases that must be determined by the land price adjustment coefficient method (coefficient K), the land price table issued by the provincial People's Committee, effective at the time of issuance of the decision on land allocation, land lease, and change of land use purpose, shall be applied, multiplied by the land price adjustment coefficient issued by the provincial People's Committee in 2015, to calculate financial obligations.

The application of coefficient K issued in 2015 also ensures compliance with the real estate market and harmonizes the interests of all parties; does not cause loss to the city budget, does not cause damage, and does not waste land resources.

Ho Chi Minh City People's Committee recognized that the deadlock in organizing the determination of specific land prices has become a bottleneck in the process of socio -economic development in the country in general.

In Ho Chi Minh City alone, hundreds of real estate projects are in a state of freezing or suspending further legal procedures due to the prolonged process of determining specific land prices. This also leads to the consequences that the projects cannot be implemented as planned, the urban appearance is inadequate, there is a lack of supply to the market, etc.

Clearing bottlenecks

Mr. Dao Quang Duong, acting Head of the Land Economics Division - Department of Agriculture and Environment of Ho Chi Minh City, informed that since the beginning of the year, the city has approved more than 70 land price plans, corresponding to a revenue of 52,000 billion VND.

It is expected that from now until the end of the year, the department will continue to submit more than 70 land valuation dossiers, collecting an additional 34,000 billion VND.

According to Mr. Duong, since the 2024 Land Law and Decree 71/2024 regulating land prices took effect, land approval and valuation have been much more convenient and faster. Typically, for Ring Road 3, within just 1 month, there was a land price plan, which was supported by the people.

However, Mr. Duong said that because many land price determination records were made before the 2013 Land Law, many difficulties were encountered.

Part of the reason is that during this period, valuation shifted from the Finance sector to the Natural Resources and Environment sector (now Agriculture and Environment), so comparative data is incomplete.

Mr. Duong cited that Ho Chi Minh City has 84 records of land allocation allowing conversion of land use purposes according to the 2003 Land Law, but the price has not yet been determined. One of the reasons is that in 2007-2010, localities such as Binh Chanh, Hoc Mon, Thu Duc, Go Vap started building apartments, but there were no apartments in this area to collect information and build land prices.

Therefore, the Department of Agriculture and Environment has sent many documents to the People's Committee of Ho Chi Minh City, proposing to the Government, the Ministry of Agriculture and Environment, and the Ministry of Finance to remove obstacles. The Prime Minister has directed the two ministries to soon invite localities to meetings to handle this content.

According to Mr. Duong, when removing obstacles for 84 files with each project of about 1,000 apartments, Ho Chi Minh City will remove obstacles and issue certificates of land use rights and ownership of assets attached to land (pink books) to about 84,000 households.

Many businesses have expressed their interest in this information. Mr. Dang Anh Tu, General Director of Saigon 5 Real Estate Joint Stock Company, said that the project's removal will create many favorable conditions for the investor to continue implementing, providing more apartments for the market as well as taking the next step related to completing legal procedures and issuing pink books. From there, businesses can contribute to the state budget revenue, which means positive results for business activities.

Contribute to development

A representative of No Va Real Estate Investment Group Corporation (Novaland) said that recently, Novaland's central Ho Chi Minh City project clusters have been actively removing legal obstacles, creating a basis for early issuance of certificates to thousands of customers.

By the end of the third quarter, nearly 1,950 pink books had been issued at Sunrise Riverside, The Sun Avenue, Kingston Residence projects... The progress of issuing pink books at other projects such as Lucky Palace (commercial lot), Orchard Garden (Officetel), Sunrise City North (Officetel)... is also being accelerated.

In the near future, Novaland is expected to have nearly 500 more pink books at a series of projects that have completed procedures. With the acceleration of pink book issuance thanks to legal solutions, Novaland quickly fulfills its financial obligations.

This is not only good news for thousands of customers but also a step forward in fulfilling financial obligations and contributing to the city's budget revenue.

"Ho Chi Minh City's determination to resolve legal problems has created conditions for businesses to fulfill their responsibilities, thereby activating cash flow and contributing to stabilizing and developing the city's economy," said a Novaland representative.
