On the afternoon of March 27, continuing the program of the 5th Conference of full-time National Assembly deputies, delegates discussed and gave opinions on the draft Law amending and supplementing a number of articles of the Law on Property Auction.

Discussing the draft Law, National Assembly delegates raised many opinions on regulations related to auctioneer standards and auction training.

Concerning the standards for auctioneers and auction training in Article 11 and Article 12 of the draft Law, delegate Nguyen Thi Viet Nga ( Hai Duong ) agreed with this draft law and the report of the Economic Committee, and said that removing the provision "cases exempted from auction training" is appropriate. According to the delegate, the time to participate in the auction training course is not too long, according to the draft regulations is 6 months, so it is convenient for those who have the need, desire, and aspiration to pursue the auction profession to participate in the training. Participating in the training course will fully equip future auctioneers with basic knowledge, skills and professional ethics, contributing to improving the quality of auction activities.

"This regulation is also appropriate in the context of the current requirement to strengthen state management in judicial support activities in general and auction activities in particular," said delegate Nguyen Thi Viet Nga.

Also interested in this content, delegate Pham Van Hoa ( Dong Thap ) said that in the past, there has been a situation where auctioneers have negative behavior, so training and education for auctioneers and these auctioneers must have the qualifications according to the law is very necessary.

In addition, regarding the regulations and standards for auctioneers exempted from training, delegate Pham Van Hoa suggested that they should be specifically and clearly regulated. Because the training of auctioneers, in addition to grasping the expertise of auctioneers, must also train and foster the awareness and consciousness of auctioneers in terms of ethics, loyalty, and conducting auctions objectively, fairly, and impartially. The draft Law needs to stipulate that auctioneers are exempted from training but must participate in the necessary training, and cannot be completely exempted.

Regarding auctions in cases where only one person registers for the auction, these are very special cases; it is necessary to clearly define which types and fields one person participating in the auction can win the auction - delegate Pham Van Hoa discussed.

In addition, delegates also said that in the context of investors taking advantage of participating in auctions, then winning the bid and forfeiting their deposits to "inflate" market land prices, it is necessary to strengthen management and handle violations in land use rights auctions. However, the nature of property auction relations is civil relations, respecting the agreement between the parties, so it is necessary to carefully consider the proposed handling measures, avoiding too deep intervention in civil relations; especially when there are regulations to handle discipline, administrative or criminal violations if there are violations in auction activities. Along with that, the Land Law 2024, which will take effect from January 1, 2025, will also contribute to overcoming some of the shortcomings that have existed in the land sector in recent times.

Previously, at the 6th Session, the National Assembly reviewed and commented on the draft Law amending and supplementing a number of articles of the Law on Property Auction. Based on the opinions of the National Assembly deputies, the Standing Committee of the Economic Committee presided over and coordinated with the Ministry of Justice, the drafting agency, and the Standing Committee of the Law Committee, to study, absorb, and revise the draft Law.

At the 31st session of the National Assembly Standing Committee, the Standing Committee of the Economic Committee reported on a number of major issues of the draft Law amending and supplementing a number of articles of the Law on Property Auction. Next, the Standing Committee of the Economic Committee chaired and coordinated with the Ministry of Justice, the Standing Committee of the Law Committee, the Ministry of Information and Communications, and the Ministry of Natural Resources and Environment to continue reviewing, absorbing and perfecting the draft Law to report at the Conference of full-time National Assembly deputies.

After being absorbed and revised, the draft Law amended and supplemented 41 articles and clauses of the Law on Property Auction (current Law), added 2 new articles and removed 1 article; increased 16 articles and clauses compared to the draft Law submitted to the National Assembly at the 6th Session (in which some articles and clauses were designed and rearranged to suit legislative techniques without changing the content).
