Drafting a Decree regulating royalties in the field of culture and arts

The Ministry of Culture, Sports and Tourism issued Decision No. 3563/QD-BVHTTDL on the development of a Decree regulating royalties in the fields of: Cinema, fine arts, photography, performing arts, press, and publishing.

This is a concrete step to institutionalize the Party and State's policies on protecting the legitimate rights of creative entities in the fields of culture and arts.

The drafting of the Decree is carried out in accordance with the direction of Deputy Prime Minister Mai Van Chinh in Official Dispatch No. 7785/VPCP-KGVX dated August 20, 2025 of the Government Office . Accordingly, the Ministry of Culture, Sports and Tourism is assigned to preside over and coordinate with the Ministry of Finance, the Ministry of Justice and relevant agencies to develop the Decree regulating royalties in the fields of: Cinema, fine arts, photography, performing arts, press and publishing.

The drafting of the Decree aims to specifically define the work contents, deadlines, completion progress, specific products and responsibilities of relevant agencies and units in organizing the implementation of the drafting of the Decree, ensuring timeliness, consistency and effectiveness.

The implementation contents include: Issuing a Plan to develop a draft Decree and establishing a Drafting Team to develop a Decree; developing a draft Decree; organizing Drafting Team meetings; developing a draft Decree and organizing Drafting Team meetings to collect comments on the draft Decree; posting and collecting comments on the Draft Decree Document; sending it to agencies and units under the Ministry, relevant ministries, branches, localities, organizations, enterprises and associations for comments; organizing workshops to collect comments from relevant ministries, branches and localities (if necessary); organizing Drafting Team meetings to synthesize, receive and explain comments; posting a summary of comments, receiving and explaining comments on the Ministry's Electronic Information Portal; sending a dossier to the Ministry of Justice for appraisal; receiving and explaining the appraisal opinions of the Ministry of Justice; completing the dossier to submit to the Government.

The Ministry of Culture, Sports and Tourism requires that the drafting of the Decree must follow the procedures prescribed by the Law on Promulgation of Legal Documents 2025 and related legal documents; ensure close coordination between agencies, organizations and units, promptly urge and remove difficulties and obstacles in the drafting process; ensure consistency and synchronization of the content of the draft Decree, and keep to the assigned schedule.

Accordingly, the Chief of the Ministry Office, Director of the Copyright Department, Director of the Press Department, Director of the Planning and Finance Department, Director of the Legal Department, members of the Drafting Team and Heads of relevant agencies and units are responsible for implementing the contents.

The development and promulgation of a Decree regulating royalties in the fields of culture and arts is a necessary step in the process of perfecting the legal framework to protect intellectual property rights, enhance the status of creators and encourage the development of the cultural industry.
