Based on the requirements in Resolution No. 66/NQ-CP and the guidance document of the Government Office , the Ministry of Agriculture and Environment has reviewed and compiled the List of Administrative Procedures related to production and business activities under the management of the Ministry of Agriculture and Environment.

Specifically, the Ministry of Agriculture and Environment manages 650 administrative procedures; 518 administrative procedures related to production and business activities under its management. The total cost of compliance with administrative procedures (currently) is over VND 9,702 billion.

Total time to resolve administrative procedures: 120 hours; 6,811 working days; 7,122 days; 30 months (equivalent to 16,667 days).

There are 845 business conditions under the Investment Law. There are 244 administrative procedures associated with business conditions.

The Ministry of Agriculture and Environment has reviewed and developed plans to reduce and simplify administrative procedures related to production and business activities under the Ministry's management.

Regarding the draft plan submitted to the Prime Minister, the Ministry of Agriculture and Environment has achieved remarkable results. One is to abolish a series of unnecessary administrative procedures, causing duplication and waste of resources. The draft plan proposes to completely abolish 19 administrative procedures, typically: Registration for access to genetic resources; Confirmation of contracts for access to genetic resources and benefit sharing; Recognition of genetically modified organism testing results; Biosafety certificates; Re-issuance of licenses/certificates; Recognition of animal feed testing methods of testing laboratories of exporting countries; Recognition of testing processes and recognition of animal feed of exporting countries...

Second, it is proposed to abolish unnecessary or duplicate business conditions. Many conditions related to physical facilities are shifted from detailed input-based management to results-based management or other legal regulations that are already included (e.g., equipment storage areas, sanitary living areas, sludge storage areas, signs indicating each area) in areas such as aquaculture, testing of aquatic/animal feed, and building/converting fishing vessels.

Some personnel conditions are also simplified, such as the abolition of the requirement to submit a copy of the graduation certificate when it can be searched on the national database. The entire business line of animal quarantine services and animal products is proposed to be abolished, with the reason being that it is no longer suitable for practice. Similarly, the service of building information technology infrastructure and building land databases is also abolished from the list of conditional business lines because the current land law no longer stipulates conditions for these lines of business.

Third is to significantly shorten the time to handle administrative procedures and optimize the process. Many procedures have had their processing time cut sharply from 30% to more than 50%. For example: Appraising dossiers to include or remove from the List of endangered, precious, and rare species prioritized for protection reduced from 75 days to 36 days; Issuing licenses to exploit endangered, precious, and rare species reduced from 60 working days to 30 working days; Issuing licenses to access genetic resources for commercial purposes reduced from 100 days to 72 days; Issuing Biosafety Certificates reduced the time from appraisal to submission for issuance of licensing decisions from 210 days to 135 days...

Fourth is to integrate and combine related administrative procedures, reducing the number of times to perform. Specifically, combine the two procedures "Licensing for limited testing" and "Licensing for large-scale testing" of genetically modified organisms into one licensing; combine the two procedures "Issuing a Certificate of Genetically Modified Organisms Eligible for Use as Food" and "Certificate of Genetically Modified Organisms Eligible for Use as Animal Feed" into a single procedure; combine the procedure "Allocating Sea Areas" with the procedure "Licensing for Aquaculture at Sea" and assign it to one agency to perform, significantly reducing the processing time from 118 days to 83 days.

The fifth is to simplify records and documents, reducing the compliance burden for businesses and people. For example, abolishing the requirement to submit documents that can be looked up on national or specialized databases, such as ID cards/Citizen identification cards, copies of graduation diplomas, or documents that have been digitized and archived; reducing the number of original documents that must be submitted, for example, reducing the risk assessment report of genetically modified crops from 10 copies to only 1 copy; abolishing the requirement to submit duplicate, unnecessary documents...

In addition, the Ministry of Agriculture and Environment also simplifies conditions on location and environment; promotes the application of information technology and digital transformation; and strongly decentralizes authority to localities.

Regarding the reduction and simplification of regulations and administrative procedures related to production and business activities, the Ministry of Agriculture and Environment proposed to reduce and simplify 276/845, reaching 32.66% of the total number of regulations on business conditions. The number of business conditions not related to investment and business sectors with conditions to be abolished is 1/43 conditions.

The number of administrative procedures related to production and business activities proposed to be reduced and simplified is 474/518 administrative procedures (of which 21 procedures are proposed to be abolished and 453 procedures to be simplified), achieving a reduction rate of 91.5% of the total number of administrative procedure regulations.

The proposed reduction in administrative procedure processing time is: 5,735 days, achieving a reduction rate of 34.41%. The total cost of administrative procedure compliance to be reduced (saved) is over VND 5,086 billion, achieving a reduction rate of 52.42%.
