The Prime Minister's directive to rectify the management, use and settlement of the state budget; strengthen digital transformation in the field of ethnic affairs; regulations on administrative sanctions in the land sector... are the outstanding instructions and management information of the Government and the Prime Minister in the week from September 28 to October 4, 2024.
Deputy Prime Minister directed to immediately deploy flycams to detect landslide risks for early warning and preventive measures.
Deputy Prime Minister Tran Hong Ha signed Official Dispatch No. 101/CD-TTg dated September 30, 2024 of the Prime Minister on urgently overcoming landslide incidents in Ha Giang and responding to the risks of landslides, flash floods and flash floods.
The Deputy Prime Minister requested the Ministry of National Defense to preside over and coordinate with the Ministry of Transport and localities to immediately deploy flycams to scan vulnerable points at risk of landslides, promptly detect traces to provide early warning and take preventive measures, evacuate residents; and ensure safety for rescue forces.
The Prime Minister directed to rectify the management, use and settlement of the state budget.
Prime Minister Pham Minh Chinh signed Directive No. 36/CT-TTg dated October 3, 2024 on the implementation of Resolution No. 132/2024/QH15 dated June 24, 2024 of the National Assembly on supplementing the state budget revenue estimate for 2022 and approving the state budget finalization for 2022.
The Prime Minister requested ministries, central and local agencies to rectify and overcome shortcomings and limitations in the establishment, management and use of the state budget; continue to focus on forecasting and making estimates of state budget revenue and expenditure close to reality; strictly manage expenditures transferred from state budget sources...
Creating new momentum for the development of Da Nang city
The Government issued a Resolution 169/NQ-CP September 30, 2024 Government's Action Program to implement Conclusion No. 79-KL/TW dated May 13, 2024 of the Politburo on continuing to implement Resolution No. 43-KL/TW of the 12th Politburo on building and developing Da Nang city to 2030, with a vision to 2045.
The Government requires that in addition to regular tasks, ministries, ministerial-level agencies, government agencies, the People's Committee of Da Nang city and localities need to specify and organize the implementation of tasks and solutions; in which, renewing thinking, strongly arousing the desire for development, determination to rise up, overcome difficulties, create new momentum to develop Da Nang worthy of its role as the center and locomotive, leading the North Central region and Central Coast.
The Government commented on two draft laws and two proposals for law making.
On October 2, 2024, the Government issued Resolution No. 174/NQ-CP Special session on law making September 2024.
At this meeting, the Government gave its opinions on: the Data Law Project, the Proposal to develop the Law on Personal Data Protection, the Law Project to amend and supplement a number of articles of the Law on Health Insurance and the Proposal to develop the Law on Lawyers (amended).
New regulations on food, clothing, and medical care for prisoners
The Government issued Decree No. 118/2024/ND-CP detailing the implementation of a number of articles of the Law on the Execution of Criminal Judgments. In particular, the Decree clearly stipulates the regimes of food, clothing, and medical care for prisoners.
Regarding diet, the Decree stipulates that prisoners are guaranteed by the State, with monthly quantitative standards including: 17 kg of rice; 15 kg of green vegetables; 1 kg of pork; 1 kg of fish; 0.5 kg of sugar; 0.75 liters of fish sauce; 0.2 liters of cooking oil; 0.1 kg of MSG; 0.5 kg of salt; other spices (equivalent to 0.5 kg of rice); fuel (equivalent to 17 kg of firewood or 15 kg of coal).
The Decree clearly states that food, foodstuffs, and fuels must ensure quality and have average prices according to local market prices.
Diet during holidays and Tet of prisoners is implemented according to the provisions of law and Clause 1, Article 48 of the Law on Enforcement of Criminal Judgments 2019.
Prisoners working in the list of heavy, toxic, and dangerous occupations as prescribed by law will have their food ration increased, but the total food intake will not exceed twice the normal daily food standard.
In addition to the above-mentioned food standards, prisoners are allowed to use their gifts and money for additional food, but not more than 3 times the food ration in 1 month for each prisoner, and must go through the custody system and canteen serving the daily life of prisoners of the detention facility.
The Government issued a Decree on electronic payment for road traffic.
On September 30, 2024, the Government issued Decree 119/2024/ND-CP regulations on electronic payment of road traffic.
The Decree clearly states that the form of operating the equipment system installed at road toll stations in the form of non-stop electronic toll collection includes: single-lane form with barrier and free multi-lane form.
Under the single-lane barrier model, the barrier at the toll station will open for vehicles to pass through when the vehicle has a valid terminal tag attached and successfully makes payment for road use.
Under the free multi-lane form, at the toll station area, only the gantry price and toll collection equipment mounted on the gantry price are maintained. This form is only applied at the entrance of the highway.
Amendments to the Vietnam Timber Legality Assurance System regulations
The Government issued Decree No. 120/2024/ND-CP dated September 30, 2024 amending and supplementing a number of articles of Decree No. 102/2020/ND-CP dated September 1, 2020 of the Government regulating the Vietnam Timber Legality Assurance System.
Decree No. 120/2024/ND-CP has added regulations on countries and territories in active geographical zones and non-active geographical zones.
According to Decree No. 120/2024/ND-CP, a country or territory is not in the active geographical area when it falls into one of the following cases:
1- Countries and territories that do not meet the above criteria;
2- Countries and territories that meet the above criteria but have evidence of illegal logging, timber trade or use of forged documents according to the laws of relevant countries.
Adding 2 cases of revoked certificates of eligibility for motor vehicle inspection activities
The Government issued Decree No. 121/2024/ND-CP dated October 3, 2024 amending and supplementing a number of articles of Decree No. 139/2018/ND-CP dated October 8, 2018 regulating the business of motor vehicle inspection services, amending and supplementing a number of articles in Decree No. 30/2023/ND-CP dated June 8, 2023 of the Government.
Accordingly, two more cases of inspection units having their certificates of eligibility to operate motor vehicle inspection revoked are added, including:
- The inspection unit uses tools and software to correct vehicle data and inspection data to legalize vehicle information and vehicle inspection results.
- The inspection unit does not maintain a department to handle work related to inspection records during the time the unit stops inspecting motor vehicles, except in cases of force majeure or objective obstacles as prescribed by law.
Administrative sanctions for violations in the land sector
The Government issued Decree 123/2024/ND-CP dated October 4, 2024, regulating administrative sanctions for violations in the land sector.
This Decree provides for administrative violations in the land sector (including: completed administrative violations and ongoing administrative violations), forms of sanctions, levels of sanctions, remedial measures, authority to draw up records, subjects of sanctions and authority to sanction administrative violations in the land sector, including violations in land use and violations in the provision of land services.
Establishment of Hanoi High-Tech Biotechnology Park
Deputy Prime Minister Bui Thanh Son signed Decision No. 1054/QD-TTg September 29, 2024, Hanoi High-Tech Biotechnology Park was established.
The High-Tech Park is under the Hanoi People's Committee with the name of Hanoi High-Tech Biological Park; with an area of 199.03 hectares, located in the wards of Tay Tuu, Lien Mac, Minh Khai, Thuy Phuong and Co Nhue 2, Bac Tu Liem district, Hanoi city.
Hanoi Bio-Tech Park has the function of carrying out high-tech activities in line with the world's high-tech development trend and Vietnam's high-tech development policies and orientations, with priority given to the field of biotechnology.
Strengthening digital transformation in the field of ethnic affairs
Permanent Deputy Prime Minister Nguyen Hoa Binh signed Decision No. 1087/QD-TTg dated October 2, 2024 of the Prime Minister approving the Project "Enhancing digital transformation in the field of ethnic affairs by 2030".
The objective of the Project is to strengthen digital transformation in the field of ethnic affairs with the aim of developing e-Government, moving towards digital Government in state management agencies on ethnic affairs, developing digital economy, developing digital society in ethnic minority areas, promoting the national digital transformation process, contributing to economic development, ensuring social security, preserving and promoting the fine cultural identity of Vietnam's ethnic minorities.
December completed the Project to establish Da Nang Free Trade Zone
Permanent Deputy Prime Minister Nguyen Hoa Binh signed and issued Decision No. 1088/QD-TTg October 2, 2024 assigning tasks to implement Resolution No. 136/2024/QH15 dated June 26, 2024 of the National Assembly on the organization of urban government and piloting a number of specific mechanisms and policies for the development of Da Nang city.
The Decision clearly states that in December 2024, the People's Committee of Da Nang City will complete the project and dossier to establish the Da Nang Free Trade Zone, send it to the Ministry of Planning and Investment for appraisal and submit it to the Prime Minister to issue the Decision on establishment. In the fourth quarter of 2024 - the first quarter of 2025, the Ministry of Planning and Investment will preside over the appraisal and submit it to the Prime Minister to issue the Decision on establishing the Da Nang Free Trade Zone.
Extending the pilot period of diving service in Nha Trang Bay
To have more time to complete legal regulations related to submersible service activities, in Document No. 724/TTg-CN dated September 28, 2024, Deputy Prime Minister Tran Hong Ha agreed to extend the pilot period of submersible service activities in Nha Trang Bay according to the proposal of the Ministry of Transport (maximum pilot period until March 30, 2025).
