Quang Nam : Enterprises propose to remove obstacles in granting certificates for real estate projects
Unable to resolve land division, transfer, registration of changes in land use rights certificates, business activities are affected, enterprises request Quang Nam province to promptly resolve this issue.
Quang Nam Provincial Business Association has just sent a document to Quang Nam Provincial People's Committee regarding difficulties and problems of enterprises.
According to the Quang Nam Province Business Association, the current difficulty in land allocation has not been implemented.
According to the business's feedback on investment phasing, to remove difficulties in allocating land for the entire project at once according to the investment policy and project phasing orientation according to the site clearance progress, Quang Nam province has a document directing the Department of Planning and Investment to guide investors to divide real estate projects into phases in accordance with the land allocation progress.
However, to date, very few projects have been able to do this.
According to the Quang Nam Provincial Business Association, the Department of Planning and Investment guides projects to be divided into phases according to the approved 1/500 planning, with synchronized technical infrastructure in each phase; not divided into phases according to the progress of site clearance and land allocation.
So this is the reason for the multiple land allocations in projects; this difficulty has not been resolved yet.

Regarding the determination of financial obligations and land use fees, Quang Nam province enterprises reported that this content has been issued by Quang Nam province with many directives and instructions. However, up to now, no project has continued to determine financial obligations.
According to the Quang Nam Province Business Association, Quang Nam Province has divided the determination of financial obligations into three groups of projects. Of which, the group of projects recommended by the Central Inspection Committee for violations is 31 projects.
The project group that has allocated land late determines financial obligations and the project group determines financial obligations according to the land allocation decision.
Each of the above groups has a completion date but in reality, no project has been implemented. Quang Nam Province Business Association recommends that Quang Nam Province promptly handle each project with a roadmap.
Regarding the issuance of block certificates and sub-certificates for each lot in the project, according to the Quang Nam Provincial Business Association, the Province has directed that projects that have been allocated land, completed financial obligations, and constructed basic technical infrastructure will be considered for issuance of block certificates.
However, due to the delay in determining financial obligations and land use fees, projects that fully meet the prescribed conditions still cannot be granted red books.
In addition, the lack of detailed regulations on conditions for granting red block books for real estate projects also causes many difficulties in the process of accepting technical infrastructure and consulting and proposing policies of departments and branches.
Currently, tax-paying enterprises have fulfilled their financial obligations and basically completed their technical infrastructure, but they are not able to resolve land division, transfer, or register changes and issue sub-books, which greatly affects their business operations.
Quang Nam Provincial Business Association recommends that the province should issue regulations on land division, transfer, registration of changes, and issuance of sub-books from block books for qualified enterprises.
In addition, the Quang Nam Province Business Association also reported that the site clearance work at the projects encountered numerous difficulties. Construction enterprises encountered difficulties with land and sand, there was no land to buy, the actual price compared to the Inter-agency price was too different, bidding resulted in losses...
In response to the proposal of the Provincial Business Association, the People's Committee of Quang Nam province requested relevant departments and branches to consider and resolve the issue within their authority. For issues beyond their authority, the People's Committee of Quang Nam province will propose and advise on specific solutions for businesses.
