May I ask what documents an individual can use to prove that he/she is the vehicle owner according to the provisions of Circular 24/2023/TT-BCA? - Reader Thien Van
What documents does the vehicle owner need according to Circular 24/2023/TT-BCA?
Specifically, Article 10 of Circular 24/2023/TT-BCA stipulates the types of vehicle owner documents in each case as follows:
(1) Vehicle owner is Vietnamese: Use level 2 electronic identification account to carry out vehicle registration procedures on the public service portal or present citizen identification card or passport.
For armed forces: Present People's Public Security ID card or People's Army ID card or certificate of the head of the agency, working unit from regimental level, department, district-level Police or equivalent or higher (in case of not being issued an armed forces ID card).
(2) The car owner is a foreigner
(i) Vehicle owner is a member of a diplomatic mission, consular agency, or representative agency of an international organization in Vietnam: Present a valid diplomatic identity card, official identity card, consular identity card, honorary consular identity card, or (ordinary) identity card and submit a letter of introduction from the State Protocol Department or the Department of Foreign Affairs;
(ii) In case the vehicle owner is a foreigner living and working in Vietnam (except for the subjects specified in (i)): Present a permanent residence card or temporary residence card (with a remaining residence period in Vietnam of 06 months or more).
(3) The vehicle owner is an organization
(i) Vehicle owners who are organizations (except for the subjects specified in (ii)): Use a level 2 electronic identification account to carry out vehicle registration procedures on the public service portal; in case the organization has not been granted a level 2 electronic identification account, it must present a tax code notification or establishment decision.
In case of military enterprise vehicles, there must be an additional letter of introduction from the Department of Vehicles and Machinery, General Department of Engineering, Ministry of National Defense ;
In case the vehicle operates in the business of transporting by car, there must be an additional copy of the business license for transporting by car issued by the Department of Transport along with the original for comparison; in case the vehicle belongs to another organization or individual, there must be a vehicle rental contract or business cooperation contract or service contract;
(ii) Vehicle owners are diplomatic missions, consular offices and representative offices of international organizations in Vietnam: Use a level 2 electronic identification account to carry out vehicle registration procedures on the public service portal; in case the organization has not been granted a level 2 electronic identification account, it must present a tax code notification and submit a Letter of Introduction from the State Protocol Department or the Department of Foreign Affairs;
(iii) The person introduced by the agency or organization to carry out the procedure must submit the vehicle owner's documents as prescribed and present identification documents as prescribed in (1) and (2).
Responsibilities of vehicle owners according to Circular 24/2023/TT-BCA
Accordingly, in each specific case, the vehicle owner will have the following responsibilities:
- Comply with the provisions of the law on vehicle registration. Carry out vehicle registration procedures on the public service portal, provide and declare truthfully, fully and accurately information on vehicle registration. Be responsible before the law for the legality of the vehicle and vehicle records.
It is strictly forbidden to falsify documents, illegally interfere with the public service portal, vehicle registration and management system to change electronic data information or change the engine number or chassis number of the vehicle for vehicle registration.
- Bring the vehicle to the vehicle registration agency specified in Article 4 of Circular 24/2023/TT-BCA for inspection of vehicles registered for the first time, registered for transfer of ownership, vehicle transfer, renovation, or change of paint color; in case the vehicle registration certificate or license plate is blurred, damaged, or lost, the vehicle owner must declare and carry out procedures for reissuance of the vehicle registration certificate or license plate (hereinafter referred to as reissuance), reissuance of the vehicle registration certificate or license plate (hereinafter referred to as reissuance) according to regulations.
- Within 30 days from the date of issuance by the competent authority of the certificate of technical safety and environmental protection of a modified motor vehicle or change of information on the vehicle owner's name or change of head office address or place of residence to another province or centrally-run city or when the vehicle registration certificate expires, the vehicle owner must go to the vehicle registration authority to carry out procedures for issuance or revocation of the vehicle registration certificate and license plate (hereinafter referred to as revocation procedures) according to regulations.
- When selling, donating, inheriting, exchanging, contributing capital, allocating, or transferring a vehicle (hereinafter referred to as transferring vehicle ownership):
+ The vehicle owner must retain the vehicle registration certificate and license plate (not give it to the organization or individual receiving the vehicle ownership transfer) and submit the vehicle registration certificate and license plate to the vehicle registration authority to carry out the revocation procedure; in case of transferring vehicle ownership along with the license plate of the auction-winning vehicle, the vehicle owner must submit the vehicle registration certificate and license plate to the vehicle registration authority to carry out the revocation procedure;
+ Within 30 days from the date of completing the vehicle ownership transfer paperwork, the vehicle owner must complete the revocation procedures; if after the above deadline the vehicle owner fails to complete the revocation procedures or hand over the vehicle registration certificate and license plate to the organization or individual receiving the vehicle ownership transfer to complete the revocation procedures, before handling the case, the vehicle registration authority shall issue a decision to sanction the vehicle owner for not completing the revocation procedures as prescribed;
In case the vehicle owner does not carry out the revocation procedure after transferring vehicle ownership, he/she shall be responsible before the law for any violations related to that vehicle;
+ After the vehicle owner completes the repossession procedure, the organization or individual receiving the transfer of ownership completes the vehicle registration procedure according to regulations.
- Within 07 days from the date the vehicle expires, the vehicle is broken and cannot be used, or the vehicle is destroyed due to objective reasons, the vehicle owner must declare on the public service portal and submit the vehicle registration certificate and license plate to the vehicle registration authority or the commune-level police (regardless of the vehicle owner's place of residence) to carry out the revocation procedure.
