Today, May 28, continuing the 7th session, the National Assembly held a plenary session at the Hall to discuss the draft Law on Organization of People's Courts (amended). Delegate Hoang Duc Thang, Deputy Head of the National Assembly Delegation of Quang Tri province, participated in the discussion.
Participating in the debate on the views of National Assembly deputies on the regulations on innovation of the organization of People's Courts at provincial and district levels according to the jurisdiction (Clause 1, Article 4) of the draft Law on Organization of People's Courts (amended), deputy Hoang Duc Thang said that this is an issue on which many National Assembly deputies and public opinion still have many different opinions because this is a new model, quite fundamentally changing the functions, tasks and organization of People's Courts at provincial and district levels, while the basic understanding of this new model still has many different understandings. There are still many concerns about this model that has not been fully and convincingly evaluated.

According to the delegate, the error here seems not to be a progressive model, many countries in the world have implemented as many opinions of the delegate have analyzed. So, is this defect that we are not ready for its birth, we have paid a very high price for haste in deciding on issues that originate from subjective will, haste, a new model may be correct in the future, but it cannot be correct when its "falling point" is not complete and suitable.
Our view on law-making is to only put into legal service issues that are mature, certain, and have been tested by practice.
Therefore, the delegate suggested that the National Assembly should not rush to decide on this new model when it is not fully prepared and ready, but should continue to give opinions so that the competent authorities can continue to research, supplement the practical basis, prove, and fully evaluate the impact of this new model. At that time, the National Assembly can decide that it is not difficult to supplement or amend a law.
Therefore, the delegate's opinion supports option 1 of maintaining the current organizational model of the People's Court at the provincial and district levels for the time being, avoiding disruption and unwanted consequences. Such an approach is cautious, certain and necessary at the present time.
