Removing barriers for effective implementation of Resolution 02

In early 2024, the Government issued Resolution 02/NQ-CP dated January 5, 2024 (Resolution 02) on key tasks and solutions to improve the business environment and enhance national competitiveness in 2024, aiming to stimulate motivation and reform spirit to help unblock resources for businesses and reduce policy burdens. For the Resolution to be effectively implemented, it is necessary to change the implementation method, add more monitoring mechanisms, and handle those who carry out institutional reforms and improve the national business environment to create breakthrough results.

Businesses complain of difficulties

Sharing about the difficulties encountered in implementing regulations and administrative procedures, Ms. Ly Kim Chi, President of the Ho Chi Minh City Food and Foodstuff Association, said that one of the regulations that has had the longest and most severe impact on food enterprises is the problem in Decree 09/2016/ND-CP of the Government on fortifying micronutrients in food. This problem has lasted for nearly 7 years, since 2017 until now, and food enterprises have been and are facing many difficulties every day.

Mr. Pham Xuan Hoe - General Secretary of the Vietnam Financial Leasing Association stated that in reality, the biggest problem with motor vehicle registration currently stipulated in Circular No. 24/2023/TT-BCA dated July 1, 2023 of the Ministry of Public Security regulating the issuance and revocation of motor vehicle license plate registration is that registration must be made at the headquarters of the financial lessor, while member financial leasing companies are all headquartered in Hanoi or Ho Chi Minh City, so many unreasonable things arise, causing difficulties for businesses.

Mr. Hoe cited evidence from four member companies, Vietcombank Leasing, BIDV - sumi Trust, ACB Leasing, Sacombank Leasing, showing that these problems have greatly affected the financial leasing activities of the companies. Specifically, 76 financial leasing contracts were canceled by customers and the total amount of money signed but unable to be disbursed by the four companies was 425.3 billion VND.

The American Chamber of Commerce in Vietnam (AmCham) also recommended that management agencies should soon have specific instructions to implement Resolution 02 into life. For example, regarding the implementation of Extended Producer Responsibility (EPR), the Resolution clearly states that enterprises are allowed to combine both self-recycling and payment of recycling support. However, up to this point, there has been no implementation instruction to remove obstacles related to EPR for enterprises as the Government has determined.

Mr. Dau Anh Tuan, Deputy Secretary General, Head of the Legal Department of the Vietnam Chamber of Commerce and Industry (VCCI), added that in many fields and professions, the problems that businesses report are rarely considered, and there is even a phenomenon of new barriers being added to the documents being drafted.

Mr. Tuan cited an example in the field of transportation, Decree 10/2020/NQ-CP dated January 17, 2020 of the Government regulating business and conditions for doing business in automobile transportation requires contract passenger transport enterprises to provide at least the content of the transportation contract to the Department of Transport by email before each trip. However, every day the enterprise has hundreds of trips, requiring the provision of such information creates huge compliance costs. From the management agency's side, it is also difficult to manage when receiving hundreds of emails every day.

For the Resolution to be effectively implemented

From the reality of enterprises, to improve the business environment, it is time to change the implementation method to create breakthrough results of this Resolution. Ms. Ly Kim Chi suggested that the implementation process of Resolution 02 must closely follow the implementation results of each content of each assigned ministry and branch. It is necessary to strengthen urging, monitoring and handling so that each civil servant, ministry and branch can fully support, handle and consider the interests of enterprises and people as their own interests.

To create a more favorable business environment, Mr. Dau Anh Tuan said that documents need to be simplified, procedure processing time shortened; electronic transactions need to be promoted; many problematic regulations related to business conditions need to be promptly amended; and strong decentralization is needed in implementing administrative procedures. In particular, businesses recommend that the practicality and effectiveness of business environment reform should be further improved.

According to Dr. Nguyen Minh Thao, Head of the Department of Business Environment and Competitiveness Research (Central Institute for Economic Management - CIEM), Resolution 02 has inherited and developed the approach that was previously implemented. Ms. Thao assessed that this Resolution sends a strong message from the Government, improving the business environment to strengthen confidence and create a foothold for businesses. However, the big challenge is to arouse motivation, create regular and continuous pressure and need the companionship of many parties; the initiative and directness of the heads of ministries, branches and agencies are important factors determining success.

Mr. Phan Duc Hieu - Standing Member of the Economic Committee of the National Assembly said that with 7 key task groups, Resolution 02 will directly and directly address the difficulties and problems that businesses are facing. Mr. Hieu suggested that in order for Resolution 02 to be implemented effectively, the implementation must be more substantial and require the participation of businesses and business associations in the policy-making process, avoiding the situation of "silent" promulgation. In particular, the drafting and promulgation of individual policies must strictly comply with Resolution 02 to consider many indicators affecting businesses.
