What did the prosecutor accused of receiving money say?

On June 16, Tien Phong reporter had a meeting with Mr. H.D.T. (Prosecutor in charge of the case of Phan Sinh Thanh (born 1982, residing in Canh Duong commune, Quang Trach district, Quang Binh province) "intentionally causing injury" and "extortion of property".

Defendant Phan Sinh Thanh's complaint at the first instance trial on June 6, that through Mr. Nguyen Duc Thuan (born 1974, Quang Phuong commune, Quang Trach district), the defendant's wife gave 2.7 billion VND to the officer in charge of the case, with the desire to comply with the law, of which Mr. T. received 880 million VND.

Mr. T. said that he knew Mr. Thuan and occasionally received shrimp and fish, but never received any money from Mr. Thuan to falsify the case file.

Regarding the accusation, when demanding an additional 660 million but not being met, the Procuracy raised the level of prosecution from Clause 1 to Clause 2 for the defendant group Phan Sinh Thanh, Mr. T. said: Accusing is the right of citizens, and the authorities will clarify the truth.

According to Mr. T., the authorities are still investigating whether Phan Sinh Thanh's group is guilty or not. The case of "extortion" from clause 1 to clause 2 is well-founded. At the end of the first investigation, the police concluded clause 1, the Procuracy found it inappropriate, and returned the case for further investigation in the direction of clause 2.

“ Previously, in phase one, based on the testimony of Linh (an accomplice in the case - PV), he received 21 million from the clam buyers, but in the file, the victims stated that Linh received more than 21 million... After reinvestigating the amount received from the victims, it was over 50 million, then item 2" - Mr. T. said.

As Tien Phong reported, at the first instance trial on June 6, trying Phan Sinh Thanh's group on charges of "intentionally causing injury" and "extortion", defendant Phan Sinh Thanh filed a complaint against the prosecutor who held the right to prosecute at the trial.

According to the complaint, this prosecutor received 880 million VND, out of the total 2.7 billion VND that the defendant's wife gave to a broker to give to those in charge of the case to comply with the law. Then the broker continued to request another 660 million to keep clause 1, but the defendant did not respond, so the Procuracy raised it to clause 2 (according to the defendant's request).

The complaint of defendant Phan Sinh Thanh is currently being handled by the Criminal Investigation Department of the Supreme People's Procuracy. The broker, Mr. Nguyen Duc Thuan, was "arrested by the authorities in an emergency" on the charge of "bribery brokerage" on the evening of June 12, 2023.

Mr. Nguyen Tien Hung, Chief Prosecutor of Quang Binh Province People's Procuracy, said: Mr. H.D.T (born in 1965) is an intermediate prosecutor, assigned to be in charge of the Phan Sinh Thanh case. " Since I took office, I have continuously issued 3 documents related to internal discipline, discipline rectification, compliance with professional regulations, legal regulations... now if any individual commits a violation, they must take responsibility. But no matter what, it affects the collective and I personally am the leader" - Mr. Hung shared.
