Determined to enforce the return of encroached land to avoid creating a bad precedent

On the morning of October 21, Vice Chairman of Lam Dong Provincial People's Committee Nguyen Minh chaired a meeting to listen to a report on the implementation of the decision to enforce the case of land encroachment in the new Ham Tien - Mui Ne Commercial and Service Urban Area Project (Area I).

Reporting at the meeting, representatives of sectors and localities said that in 4 cases of land encroachment in the new Ham Tien - Mui Ne Commercial and Service Urban Area Project (Area I), the People's Committee of Phu Thuy Ward had completed the enforcement of 3 households, then handed over the land to Branch of Land Fund Development Center No. 1 for management.

Ms. Tran Thi Thuy's household alone has occupied State land with an area of ​​over 77,221.6 ^{square meters} , and despite many attempts to persuade them, they still refuse to hand it over.

In August 2025, the Chairman of Lam Dong Provincial People's Committee issued a decision to enforce the implementation of remedial measures, restore the original state of the land before the violation and return the land.

According to the plan, on October 15 and 16, the People's Committee of Phu Thuy ward will organize enforcement to force Ms. Tran Thi Thuy to take remedial measures according to the decision of the Chairman of Lam Dong Provincial People's Committee.

However, on October 14, the People's Committee of Phu Thuy Ward received a document from the People's Court of Region 12 requesting the Provincial People's Committee to temporarily suspend the enforcement of the above enforcement decision and wait for the trial results of the Court.

At the meeting, the leader of the People's Court of Region 12 said that the document was issued after the unit received a lawsuit from Ms. Tran Thi Thuy.

This is a document requesting coordination to avoid difficult-to-remedy consequences, not an administrative decision.

The meeting also recorded many opinions from leaders of departments and branches, including the request to continue implementing the enforcement decision, the implementation must ensure the legitimate rights and interests of organizations and individuals according to the provisions of law.

Concluding the meeting, Mr. Nguyen Minh, Vice Chairman of Lam Dong Provincial People's Committee, highly appreciated the opinions of departments, branches and localities in resolving the case of encroachment on State land. At the same time, he said that the encroachment of land by people was due to many difficulties and problems in the project implementation process and the State management work was not strict in the past.

The Vice Chairman of the Provincial People's Committee also emphasized that the act of encroaching on land managed by the State is unacceptable. If this situation is not resolved completely, it will create a bad precedent, affecting the socio -economic development of the province. Therefore, it is requested that immediately after the meeting, the Department of Agriculture and Environment is responsible for presiding over and coordinating with relevant departments, branches and the People's Committee of Phu Thuy Ward to fully collect all documents to provide as requested by the Court.

To ensure legal compliance, the Provincial People's Committee also requested the People's Court of Region 12 to soon issue a document according to the coordination regulations or issue a decision according to regulations to have a basis for application.

The Vice Chairman of the Provincial People's Committee assigned the Department of Agriculture and Environment to preside over and coordinate with relevant departments, branches and localities to advise the Provincial People's Committee to comprehensively report on the progress of handling this case so that the Provincial People's Committee can report to the Standing Committee of the Provincial Party Committee and the Standing Committee of the Provincial Party Committee according to regulations.

There must be specific reasons for unachievable tasks, and responsibilities and causes must be identified in the spirit of solidarity, focusing on removing difficulties and obstacles for the common development of the province.
