When are pedestrians fined for traffic violations?

On November 4 and 7, Traffic Police Team No. 6 (Traffic Police Department of Hanoi City Police) continuously punished many cases of pedestrians violating traffic laws, mainly for the following violations: Walking in the wrong lane; crossing the median strip; crossing the street in the wrong place or not ensuring safety.

When fined for crossing the street in the wrong place, Mr. T. (Cau Giay District) said that he was in a hurry to catch the bus so he did not go up the pedestrian bridge but went directly across the median strip to cross the street. For his mistake, Mr. T. was fined 80,000 VND.

According to a representative of Traffic Police Team No. 6 (Traffic Police Department of Hanoi City Police), many pedestrians have the habit of crossing the street carelessly. When traffic police stop to remind and handle the situation, they appear surprised and say they do not know the rules.

The 2008 Road Traffic Law sets out traffic rules and prohibitions for pedestrians.

Clause 4, Article 26 states: Pedestrians are not allowed to enter the highway, except for people, vehicles, and equipment serving the management and maintenance of the highway.

Article 32 of the 2008 Road Traffic Law clearly stipulates the principles of traffic participation with pedestrians:

Pedestrians must walk on sidewalks or curbs; in cases where there are no sidewalks or curbs, pedestrians must walk close to the edge of the road. Pedestrians may only cross the street where there are traffic lights, road markings, or pedestrian overpasses or tunnels, and must obey traffic signals.

In cases where there are no traffic lights, pedestrian crossings, overpasses, or tunnels, pedestrians must observe oncoming vehicles, only cross the street when it is safe, and are responsible for ensuring safety when crossing the street.

Pedestrians must not cross the median strip or hang onto moving vehicles; when carrying bulky objects, they must ensure safety and not cause obstacles for people and vehicles participating in road traffic.

This Article also stipulates that children under 7 years old must be led by an adult when crossing urban roads or roads with frequent motor vehicles; everyone has the responsibility to help children under 7 years old when crossing the street.

A representative of Traffic Police Team No. 6 stated that when violating these rules, pedestrians will be punished according to Article 9 of Decree 100/2019.

Accordingly, fines of 60,000 to 100,000 VND will be imposed on pedestrians who commit violations such as: not walking on the prescribed road section; crossing the median strip; crossing the road in the wrong place or not ensuring safety; not obeying the commands or instructions of traffic lights, signs, or road markings.

Failure to comply with the orders or instructions of traffic controllers or traffic inspectors; carrying bulky objects that obstruct traffic; hanging on to moving vehicles will be subject to a fine of 60,000 - 100,000 VND.

Fines of 100,000 to 200,000 VND for pedestrians entering the highway, except for those serving in highway management and maintenance.
