Landslide occurred 2 years ago, emergency construction order issued
On September 13, the Inspectorate of Bac Lieu province said that through an inspection at the Management Board of Investment Projects for Construction of Agricultural and Rural Development Works (BQLDA NN&PTNT) of Bac Lieu province, it discovered many violations in the Emergency Project to handle erosion holes and reinforce the riverbed within the scope of the Ganh Hao Fishing Port project.
According to the inspector, the landslide incident occurred in February 2019, but it was not until July 2021 (more than 2 years) that the Department of Agriculture and Rural Development and the Project Management Board of Agriculture and Rural Development implemented the process and procedures for issuing an emergency construction order to advise the Standing Committee of the Provincial People's Committee and the Standing Committee of the Provincial Party Committee, which did not ensure the timeliness of the emergency construction as prescribed. In addition to the above landslide incident, landslides continued to occur in the wastewater treatment station area in 2020 and 2021. However, the Department of Agriculture and Rural Development and the Project Management Board of Agriculture and Rural Development did not mention it in the documents submitted for issuing the emergency construction order, which did not demonstrate the urgency. At the same time, the nature of the emergency construction is to be handled promptly, but the Department of Agriculture and Rural Development's proposal to extend the Emergency Order is not appropriate.
The inspector also discovered that the Agriculture and Rural Development Project Management Board approved the contractor selection plan without the proper authority as prescribed. Specifically, for package 01 (construction survey consultancy and feasibility study report preparation), the Project Management Board paid the consulting unit, Bac Lieu Construction Consulting Joint Stock Company, an excess of more than 221 million VND, which the investor has not yet recovered.
On the other hand, the MARD Project Management Board paid the entire contract value to the consulting unit before the feasibility study report was approved, which was not in accordance with the terms of the contract. Therefore, the inspectorate proposed to recover and pay to the state budget the amount of more than 221 million VND.
Designate incompetent contractors
According to the inspector, for package 08 (audit costs), the investor decided to select an independent audit contractor in Decision No. 49/QD-DANN dated March 3, 2022 without the opinion of the investment decision maker, which is against the regulations.
In Package 09 Construction of erosion treatment and riverbed reinforcement, the MARD Project Management Board approved the contractor selection results in Decision No. 254/QD-DANN dated December 2, 2021, the contractor selection method is shortened appointment bidding, contract type according to adjusted unit price, contract implementation period of 210 days (from the date of commencement of the project). The unit designated to bid for Package 09 is the Joint Venture of Hoang Giang Investment and Construction Joint Stock Company - Phan Hien Construction Trade Service Company Limited (Hoang Giang - Phan Hien Joint Venture) in Contract No. 04a/2021/HD-XD dated December 2, 2021 with a value of VND 48,312,088,000, the payment value up to August 23, 2023 is VND 25,193,791,000. Through checking the designated package 09 and comparing the capacity profile of this consortium, the Provincial Inspectorate discovered that Phan Hien Company could not prove its technical capacity such as: key personnel, machinery, equipment, construction solutions, but the Agriculture and Rural Development Project Management Board did not request clarification. At the same time, there were no measures to verify information about Phan Hien Company's capacity, leading to the investor not detecting that Phan Hien Company provided dishonest information for 02 similar contracts (the contractor confirmed that 02 similar contracts shown in the capacity profile were not actually implemented). In addition, the Inspectorate also discovered that the Agriculture and Rural Development Project Management Board reported to request the policy to extend the contract implementation period and extend the project implementation period while the project implementation period had expired, which did not ensure timeliness. On the other hand, the Agriculture and Rural Development Project Management Board requested the policy to advance payment exceeding 50% of the contract value to meet the conditions to accelerate progress. However, the slow construction progress led to the contract implementation period having to be extended twice (the second extension was until December 31, 2023). As of the time of inspection, the advance payment period was more than 2 years but the project had not been completed... According to the Bac Lieu Provincial Inspectorate, the above violations were mainly the responsibility of the Director of the Department of Agriculture and Rural Development, the Director of the Agriculture and Rural Development Project Management Board and related individuals at the time of responsibility. Specifically, in the work of advising and submitting to competent authorities to issue orders for urgent construction works and extending the time to implement the emergency order, the timeliness was not ensured. The Director of the Agriculture and Rural Development Project Management Board in the work of selecting contractors did not do a good job of assessing the capacity of contractors to appoint contractors for emergency packages, leading to prolonged construction time and not ensuring timeliness to overcome the consequences of natural disasters.
