In Clause 1, Article 23 of the 2023 Law on Identification , the order and procedures for issuing identification cards to people aged 14 and over are prescribed as follows:
The recipient checks and compares information of the person needing an ID card from the National Population Database, national database, and specialized database to accurately identify the person needing an ID card.
The recipient collects identity information and biometric information including facial photo, fingerprints, and iris of the person requesting an ID card.
The person needing an ID card checks and signs the ID information receipt form.
The recipient issues an appointment to return the ID card.
The ID card is returned to the location stated in the appointment letter. In case the person who needs the ID card requests to return the ID card at another location, the ID management agency will return the ID card at the requested location and the person must pay the delivery service fee.
In addition, persons under 14 years of age or their legal representatives are required to request the ID management agency to issue an ID card. The procedures for issuing an ID card to persons under 14 years of age are as follows:
Legal representatives carry out procedures to issue ID cards for people under 6 years old through the public service portal or national identification application.
In case a person under 6 years of age has not registered their birth, the legal representative shall carry out the procedure for issuing an ID card through the procedures linked with birth registration on the public service portal, the national identification application or directly at the ID management agency. The ID management agency does not collect identity information and biometric information for people under 6 years of age.
Persons aged 6 to under 14 years old and their legal representatives shall come to the identification management agency to collect identification information and biometric information as prescribed. The legal representative of a person aged 6 to under 14 years old shall carry out the procedures for issuing an identification card on that person's behalf.
According to the Law on Identification, in case a person loses civil capacity or has difficulty in cognition or behavior control, he/she must have a legal representative to assist in completing the procedures as prescribed. In case of refusal to issue an identification card, the identification management agency must respond in writing and state the reason.
Regulations on places to carry out procedures for granting, changing and re-granting ID cards
The 2023 Law on Identification clearly stipulates: The identification management agency of the District, County, Town, City Police, City of a centrally-run city or the identification management agency of the Provincial or Central-run City Police where the citizen resides.
The identity management agency of the Ministry of Public Security for cases decided by the head of the identity management agency of the Ministry of Public Security.
In case of necessity, the identification management agency shall organize the procedures for issuing identification cards at the commune, ward, town, agency, unit or at the citizen's place of residence.
