In recent years, the number of foreign lecturers and scientists working at educational institutions in Vietnam has continuously increased, making an important contribution to improving the quality of training, promoting scientific research and transferring knowledge and technology. However, the current legal system only provides general regulations on foreign labor management, and does not have a separate legal corridor for the education sector. This makes recruitment and employment inconsistent, causing difficulties for training institutions and not creating peace of mind for foreigners.

The draft decree was drafted by the Ministry of Education and Training to overcome shortcomings and concretize the policy of developing high-quality human resources, promoting the process of international integration in education, science and technology. The new document will both create favorable conditions for foreigners to work in Vietnam and improve the effectiveness of state management, ensure national security, social order and preserve national cultural identity.
The draft sets out clear requirements on professional qualifications and experience for each subject such as: Foreigners holding management positions at educational institutions from kindergarten to university must have appropriate degrees (bachelor, master, doctorate), accompanied by at least two years of management experience, except in cases of professor, associate professor or academician titles. International lecturers and researchers also need to meet the requirements of professional qualifications, teaching or research experience, and the ability to use the language of instruction in the curriculum fluently. In particular, individuals with outstanding achievements such as owning patents, winning prestigious scientific awards or being nominated by international organizations can be considered for approval even if they do not fully meet the usual conditions...
With the new regulations, Vietnam aims to build an attractive and transparent academic environment, helping international experts and lecturers to develop their capacity, while creating a legal basis for domestic schools, institutes and educational organizations to cooperate and recruit more easily. This is also a step demonstrating Vietnam's commitment to open up and deeply integrate in the fields of education and scientific research, contributing to enhancing the position of Vietnam's higher education and research system in the international arena.
Currently, the Ministry of Education and Training is continuing to collect comments from domestic and foreign agencies, organizations and experts before submitting the decree to the Government for promulgation.
