BTO-Implementing the program of the 8th Session, this afternoon, October 28, the National Assembly held a plenary session at Dien Hong Hall, listening to the drafting and reviewing agencies report on the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army (VPA). Vice Chairman of the National Assembly Tran Quang Phuong chaired the meeting. Next, the National Assembly discussed in groups the draft Law amending and supplementing a number of articles of the Law on Officers of the VPA. The National Assembly delegation of Binh Thuan province participated in the discussion in Group 15.

Authorized by the Prime Minister, at the meeting, Minister of National Defense Phan Van Giang presented the Report on the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army. The structure of the draft Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army includes 2 articles: Article 1. Amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army No. 16/1999/QH10, which has been amended and supplemented by a number of articles according to Law No. 19/2008/QH12 and Law No. 72/2014/QH13 and Article 2. Effective date.

The Minister of National Defense emphasized that the amendment and supplementation of a number of articles of the Law on Officers of the Vietnam People's Army aims to continue institutionalizing the Party's guidelines and policies and the State's legal policies on officer building. It ensures constitutionality, legality, consistency, and synchronization with the system of relevant legal documents; ensures the secrecy of the Army's organizational structure. At the same time, it ensures feasibility and conformity with the actual conditions of the Party and Army's personnel work.

Reviewing the draft law, Chairman of the National Defense and Security Committee (NDSC) Le Tan Toi said that the NDSC agreed on the necessity of promulgating the Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army. Regarding specific contents, Chairman of the NDSC Le Tan Toi requested the Agency in charge of drafting the report to clarify further the implementation of social insurance regimes and policies after increasing the maximum service age of officers, the impact on health when working in a special working environment (armed forces). At the same time, consider adjusting the retirement age of female officers with the rank of Colonel to comply with the provisions of the Labor Code and the Law on Social Insurance, ensuring gender equality and taking advantage of qualified and experienced female human resources in the military...

Participating in the discussion at the group, Deputy Head of the National Assembly Delegation of Binh Thuan Province Nguyen Huu Thong expressed his high agreement on the necessity of promulgating the Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army with political, legal and practical bases as stated in the Government's Submission. At the same time, he affirmed that the promulgation of the Law aims to fully institutionalize the Party's guidelines and policies and the State's policies on building a strong contingent of officers of the Vietnam People's Army, meeting the requirements of basically building a lean, compact and strong Vietnam People's Army by 2025; creating a solid premise to strive for building a revolutionary, disciplined, elite and modern Vietnam People's Army by 2030, which is very necessary.

Commenting specifically on Clause 12, Article 1 (Amending and supplementing Clauses 1 and 2 and adding Clause 2a after Clause 2, Article 46 of the Law on Officers of the Vietnam People's Army); delegate Nguyen Huu Thong basically agreed with the review opinion of the Standing Committee of the National Defense and Security Committee, which is to request the drafting agency to consider the regulation of Point b, Clause 12, Article 1 to ensure consistency and synchronization with the Housing Law, Land Law, and Planning Law; clarifying the resources for implementation when the Law is promulgated to ensure feasibility; reporting to clarify more difficulties and problems regarding the authority, order and procedures for implementing housing policies for the people's armed forces under current laws.

According to the delegate, for the law to truly come into life, it is necessary to specifically stipulate the allocation of resources to solve the housing regime for officers, especially for new officers and newly married officers who have not yet had the conditions to save. In addition, it is necessary to specifically assess the resources for implementation of the province or the resources of the armed forces to invest in housing for officers and soldiers of the force. If the process is assigned to the army, it is necessary to specifically stipulate the procedures according to the Land Law, the Planning Law, and the Housing Law accordingly.

Regarding housing support policies for officers, according to delegate Nguyen Huu Thong, although current legal regulations have provisions on housing support policies for officers, specifically: Clause 7, Article 31, Law on Officers amended in 2014 stipulates that for active officers: "Enjoy housing allowances; enjoy social housing support policies, and be guaranteed public housing according to the provisions of law". However, in reality, the number of military officers enjoying housing benefits is still very small compared to the need, because the regulations do not have specific provisions on the level of housing allowances, housing support, and ensuring public housing for each subject for the armed forces of the People's Army, so there are many difficulties and shortcomings in the implementation process. Therefore, in order for this policy to truly come into life, delegates suggested that it is necessary to have specific regulations and allocate resources to solve housing conditions for officers. Especially for newly married officers who do not have the conditions to save up to buy a house to help reduce difficulties in life and family of the cadres, feel secure in their work, stay with the unit and the force, and complete assigned tasks well.

Commenting on the promotion of military rank and salary increase of officers ahead of schedule (Clause 5, Article 1 of the draft), delegates basically agreed with the draft Law. However, regarding the promotion of military rank and salary increase ahead of schedule for officers, strict regulations are needed to ensure attention and create favorable conditions for officers with achievements, especially for the contingent of officers at the grassroots level, officers in units with sufficient troops ready for combat, remote areas, border areas, islands, and areas with special economic difficulties... At the same time, there should be policies on military rank and position allowances for the contingent of officers holding assistant positions in agencies because this is a contingent of officers with qualifications and experience in staff work, guidance, and a large workload, but the ceiling of military rank and position allowances is still low compared to the general level. Delegates also agreed that the draft Law should be approved according to the 1-session process.
