85 cases of houses and construction works formed after the time of project investment policy approval

(DN) - According to the Land Fund Development Center of Dong Nai province, currently, at the Project to Create an Interchange between National Highway 51 and Ben Luc - Long Thanh Expressway, there are about 85 cases of houses and other constructions built on the land recovered from the remaining section of the Ben Luc - Long Thanh Expressway Project after the time the Ministry of Transport (now the Ministry of Construction) approved the investment policy.

Specifically, the project was approved by the Ministry of Transport (now the Ministry of Construction ) in October 2010. After that, the Prime Minister approved the compensation, support and resettlement policy framework, including the area of ​​the intersection of National Highway 51 with the Ben Luc - Long Thanh Expressway located in Intersection No. 9 of the Ben Luc - Long Thanh Expressway Project in September 2011. However, at this time, for Intersection No. 9, the project investor reported that it would implement it after the Bien Hoa - Vung Tau Expressway was formed. Therefore, this area has not been surveyed for land acquisition, and no land acquisition notice has been issued.

Up to now, when implementing land acquisition and site clearance to implement the construction of intersections, there have been about 85 cases of houses and other constructions built on the acquired land after the time of investment policy approval (2010). Of which, there are about 44 cases where the current status has formed new land plots (these cases were transferred, donated by handwritten papers..., of which some have had registration receipts in 2014). According to the Land Law 2024, these 44 cases will not be eligible for resettlement consideration, so the authorities have encountered difficulties in mobilizing households to relocate and hand over the site to implement the project.

In these cases, the Provincial Land Fund Development Center recommends that the Provincial People's Committee approve the Long Thanh Branch of the Land Fund Development Center (the unit performing the site clearance work) to apply the 2024 Land Law and decrees, documents guiding the Land Law, and decisions of the Provincial People's Committee at the time of land recovery to implement the project.

To build the intersection between National Highway 51 and Ben Luc - Long Thanh Expressway, the provincial authorities must reclaim nearly 3 hectares of land from 115 cases. Of which, it is expected that about 75 households (including cases considered by generation) will be considered and resettled.
