Setting landmarks to distinguish forest land from other types of land
Regarding the planning work of managing and protecting protective forest land in Soc Son district, Mr. Le Minh Tuyen, Head of Hanoi Forest Protection Department, informed that recently, Hanoi Forest Protection Department has advised the Department of Agriculture and Rural Development to propose the City People's Committee to issue Plan No. 57, which includes the assignment of districts and towns with forests, including Soc Son district, to carry out the work of reviewing the current status of forests, measuring and marking the boundaries of 3 types of forests in the management area.
It is necessary to promptly review the current status of forests, measure and set up markers and boundaries.
“Soc Son district is entirely protected forest. The review and measurement of boundaries between forestry land and other types of land will distinguish protection forest land from other types of land in the area. After the results of the review and measurement, Soc Son district will coordinate with departments and branches to propose to the Hanoi People's Committee to adjust the Soc Son forest planning to be consistent with the general planning of the city,” said Mr. Tuyen.
A representative of the Hanoi Forest Protection Department said that violations of construction and land leveling often occur annually in areas planned for forestry land.
“Violations on forestry land will of course cause difficulties in the management, protection and sustainable development of forests. The Department of Agriculture and Rural Development will coordinate with the People's Committee of Soc Son district to propose a definitive handling of violations according to the law,” said Mr. Tuyen.
The representative of Hanoi Forest Rangers said that regarding violations in the forest area planned for forestry land, the Hanoi Forest Rangers Department has directed local Forest Rangers to coordinate with the Commune People's Committee to establish cases of violations and propose to the competent authority to handle them. However, the Forest Rangers do not have the authority to impose penalties, so they only coordinate with the commune to draw up a record of violations and propose to the competent authority to handle them according to regulations.
Separation of overlapping land areas
Regarding the forest land area that has not been transferred by Soc Son district to the Hanoi Special-Use Protection Forest Management Board, according to the decision of the Hanoi People's Committee, the People's Committee of Soc Son district will hand over the entire protective forest area to the Hanoi Special-Use Protection Forest Management Board for management.
In 2021 and 2022, the district will hand over 1,150 hectares, the remaining more than 1,000 hectares. The City has also directed the district to continue reviewing the current forest status and handling violations of illegal forestry land use and coordinate with departments and branches to separate areas of overlapping land with records. (For example, land with records as residential land before 1993 from forestry land and handle all violations on the remaining forest land area) to hand over the remaining to the Hanoi Special-Use Forest Management Board (MB) and forestry land according to regulations.

“When handing over the remaining area to the Management Board, firstly, it will ensure that the forest has a manager - a series of forest types. The manager will fully perform the functions and responsibilities of a forest owner according to the law that has been allocated land and forest. The forest owner must develop a sustainable forest management plan according to the law, thereby improving the quality of the forest will be more effective. Forest development and promoting the biodiversity of the forest will be improved.
In particular, when there is a plan for sustainable forest development, forest owners can also develop plans for forestry land use (strictly protected areas, ecologically developed areas, and agro-forestry development areas). From there, the economic income of the unit will increase, the forest area will increase day by day from forest protection and management, and disputes and illegal land use will be avoided. At that time, the responsibility of each organization and individual will be clarified if there is a violation," said Mr. Tuyen.
At the Notice of Conclusion of the Conference on measures to handle violations of land and construction order in Minh Phu and Minh Tri communes on August 16, Vice Chairman of Soc Son District People's Committee Pham Quang Ngoc assigned the Department of Natural Resources and Environment to clearly state: after handling and enforcing violations, advise the District People's Committee to decide on land recovery, for land allocated to forests, issuing forest registers, advise the District People's Committee to request the Department of Agriculture and Rural Development to recover and hand over for management according to regulations.
Guide communes with forests (especially in Minh Phu and Minh Tri communes that are new economic zones and are allocated land according to the standard of 400 m2) to compile statistics on land allocation cases, compare management books and regulations to determine whether households have transferred all or transferred more than the area, in order to strictly manage and avoid complaints and claims for land outside the granted standards.
