Presenting the draft Law on amending and supplementing a number of articles of 10 laws related to security and order at the meeting of the National Assembly Standing Committee on the afternoon of September 23, Deputy Minister of Public Security Nguyen Van Long said that to suit the reality and remove difficulties for transport enterprises, the draft law proposes to amend the provisions of the Law on Road Traffic Order and Safety regarding the working hours of drivers in a day.
Accordingly, the driver's continuous driving time shall not exceed 4 hours. The driver's working time in a day or a week shall comply with the provisions of the Labor Code.
This amendment is explained to help facilitate production and business activities of transport enterprises.
Another issue of interest to members of the National Assembly Standing Committee is related to strengthening the management of road transport business activities through monitoring devices to ensure traffic safety.
The main contents include expanding the subjects that must be installed (adding regulations that transport business vehicles must install a device to record the driver's image; internal transport vehicles must install both a journey monitoring device and a device to record the driver's image; passenger cars with 8 seats or more (transport business) must install an additional device to record the passenger compartment image).
Through the review, Chairman of the National Defense, Security and Foreign Affairs Committee Le Tan Toi affirmed that the Committee basically agreed on the scope of amending and supplementing 10 laws related to security and order.
“However, there are opinions suggesting that it is necessary to study and evaluate the full and comprehensive impact on the cost of compliance with the law and the right to protect privacy regarding the regulations requiring vehicles to install journey monitoring devices, devices to record images of the driver and images of the passenger compartment. It is recommended to consider the regulation on installing passenger compartment monitoring devices, because it is related to personal data and privacy of passengers,” said Mr. Le Tan Toi.
According to Chairman Le Tan Toi, there are opinions in the inspection agency that the regulation on continuous driving time not exceeding 4 hours and the reference to the Labor Code is not strict and not suitable to the nature of labor. This opinion suggests studying and clearly regulating the maximum driving time in a day, month; the maximum overtime hours for drivers in a day.
Concluding this content, Vice Chairman of the National Assembly Tran Quang Phuong stated that after receiving and explaining the opinions of the National Assembly Standing Committee, the draft law is eligible to be submitted to the National Assembly for consideration and approval at the 10th session according to the 1-session process.
