An Thinh apartment building has water leakage, management board turns a blind eye

Residents of An Thinh Apartment (Ngo Gia Kham Street, Bac Nha Trang Ward) have just sent a petition to Khanh Hoa Newspaper and Radio and Television reporting that the apartment building has been seriously leaking water for more than a year now, with the risk of affecting the overall structure of the building. Although residents have continuously reported, up to now, the Management Board of An Thinh Apartment has not shown its role and responsibility in promptly repairing the damage.

An Thinh Apartment Building, invested by Khanh Hoa Housing Development One Member Co., Ltd., was inaugurated in November 2015. This apartment building has 9 floors with 160 apartments. According to the complaint, in early 2024, residents discovered that some apartments at An Thinh Apartment Building were leaking water. Water mainly seeped from the toilets of the apartments above, leaked into the gene box, and seeped down along the vertical axis of the building. Many families had to use foam boxes to catch the water flowing from the houses above. Due to not being remedied in time, the water seepage has now spread to many apartments, threatening to affect the structure of the entire building. Residents have complained many times, but the Apartment Management Board has not taken any action, and has not hired an independent inspection unit to inspect and fix it.

Mr. Phan Hung Phi (owner of apartment 109, An Thinh Apartment) said that in mid-2024, he discovered that his apartment was leaking water at the bathroom ceiling. Water flowed down a lot in the morning and afternoon when people came home to use the bathroom. Mr. Phi reported to Mr. Nguyen Hong Tin - Head of An Thinh Apartment Management Board, but Mr. Tin only gave a general answer that the water was leaking from the gene box, and had to be cut open and hired an inspection unit to make an accurate diagnosis. “When I complained many times, Mr. Tin said that the house above had a leak, so the house below had to pay to fix it. I found it unreasonable, but I had to accept spending 4 million VND to hire someone to fix the bathroom of apartment 209. When the repairman came to fix it, he discovered that the toilet in apartment 209 had collapsed, and water was leaking out and seeping into my apartment. When I checked, the leak in my apartment's bathroom was worse, and the water was seeping down to the parking lot. After that, a series of apartments on the same axis all complained about the leak, but they fixed it themselves, small and not uniformly. Some houses fixed it, some didn't, so this situation could not be completely resolved,” Mr. Phi said.

Mr. Tran Trong Dai (owner of apartment 119) said that his house had water seepage in the bathroom, which was not promptly repaired, so the wall showed signs of rotting. Mr. Dai reported to the management board in May 2025, but so far, it has not been taken care of. "I propose that the management board hold a meeting with residents, agree to hire an independent inspection unit to survey, find the cause and report on the solution. The funding can be from donations or taken from the apartment maintenance fund currently deposited in the bank. More than 50% of residents agree to carry out repairs immediately to avoid the apartment building deteriorating beyond repair," Mr. Dai said.

According to the provisions of Point d, Article 148 of the 2023 Housing Law, the apartment building management board is responsible for selecting and signing a maintenance contract for the common property of the apartment building and supervising maintenance activities according to the regulations on management and use of apartment buildings. Maintenance of the common property can be carried out by the unit currently managing and operating the apartment building or another unit with maintenance capacity according to the provisions of the law on construction. Thus, when detecting signs of deterioration in the apartment building, the apartment building management board must immediately notify the owner, user and relevant parties about the condition of the building; contact the management and operation unit, experts or competent authorities to assess the condition and propose remedial measures. At the same time, coordinate with relevant parties to carry out repairs and maintenance in accordance with regulations and ensure safety for residents. Before repairs, the management board must hold a meeting with residents to inform them of the repair plan and progress, ensuring that repairs and maintenance are carried out transparently and in accordance with regulations.

Regarding this issue, the leaders of the People's Committee of Bac Nha Trang ward assigned the Department of Economics , Infrastructure and Urban Areas to set up a team to inspect the quality of An Thinh Apartment Building, work with the Apartment Management Board to listen to the report and find a solution.
