Agricultural land in the Red River and Day River banks... is used for tourism and experiential education.

At the 25th session, taking place from July 7 to 10, the Hanoi People's Council passed a resolution regulating the use and exploitation of agricultural land funds on river banks and floating banks on diked rivers in Hanoi.

Use of agricultural land on river banks with dikes for tourism

According to Hanoi, the above resolution stipulates the form of use and exploitation of agricultural land funds on river banks and floating banks on diked rivers for agricultural production, ecological agricultural production, agriculture combined with tourism and experiential education .

The Resolution does not include investment projects to construct works in river banks and floating areas on diked rivers in Hanoi according to the provisions of law on construction investment.

According to Article 6 of the resolution, regulations on the form of use and exploitation of agricultural land funds on river banks and floating banks on diked rivers for agricultural production combined with tourism and experiential education. Specifically:

Organizations and individuals using and exploiting agricultural land funds on river banks and floating banks on diked rivers for agricultural production combined with tourism and experiential education must comply with regulations on multi-purpose land use according to the provisions of the law on land.

At the same time, part of the land area can be used to build works directly serving agricultural production, ecological agricultural production, agriculture combined with tourism, experiential education and other technical infrastructure works, but must comply with general principles.

Total land area must be from 10,000m²

Hanoi also requires a total land area of ​​10,000m² or more (including one plot or many adjacent plots of land of the same land user).

"The plan for using land for multiple purposes for agricultural production combined with tourism and experiential education, including design solutions for construction of works on land approved by competent authorities" - the resolution clearly states.

The Resolution also stipulates that the construction and installation location must be outside the protection range of dikes and irrigation works, not in landslide areas or areas at risk of dangerous landslides. Not regularly affected by flooding due to river floods, with a natural elevation equivalent to flood level I or higher in the area.

At the same time, it must comply with regulations on the use of river banks according to flood prevention and control planning. In particular, for river banks belonging to the Day River system, they must be outside the flood escape corridor.

For river banks in the Red River and Thai Binh River systems, they must be located in the river bank area being researched for construction.

In addition, it is necessary to commit not to fill or raise the existing riverbank; to self-dismantle or move the construction; and not to receive compensation when the project expires or when the competent state agency decides to reclaim and implement the project.

"The total construction area of ​​the works must not exceed 5% of the land area outside the flood escape corridor for the Day River system, or in the riverbank area being studied for construction for the Red River and Thai Binh River systems (not including shared technical infrastructure works)" - Hanoi requires.

Regarding the structure of semi-permanent buildings, environmentally friendly materials must be used, easy to disassemble and move; the building must be 1 floor, no more than 6m high and have no basement.
