On the morning of June 27, the Ministry of National Defense held a conference to review the implementation of the law on participation in United Nations Peacekeeping (UNPKO).
Colonel Pham Manh Thang, Director of the Vietnam Department of Peacekeeping Operations, said that on November 13, 2020, the National Assembly passed Resolution 130 on participating in the UN peacekeeping force; the Government issued decrees stipulating a number of regimes and policies for participating in UN peacekeeping operations.
Since Resolution 130 took effect, Vietnam has dispatched 2 Engineering Teams, more than 40 individual positions, and rotated 2 Level 2 Field Hospital teams.
Colonel Pham Manh Thang said that participation in UN peacekeeping activities has basically been carried out synchronously and effectively, achieving many important results, creating a positive effect on Vietnam's responsibility towards the international community.
However, Colonel Pham Manh Thang shared that the implementation and assurance of regimes and policies for forces at some missions are still confusing and inadequate and have not received consensus and agreement from some ministries and branches. National coordination on participation in the UN peacekeeping force is still unclear and has not been implemented synchronously and systematically, leading to many difficulties in selection and training. Some regimes and policies have not met practical requirements, are not highly preferential and encouraging, and do not cover all subjects.
To perfect the legal system and overcome limitations, creating a favorable legal corridor for the implementation of tasks assigned by the Party, State and Government, Colonel Thang proposed that the Prime Minister assign the Ministry of National Defense to preside over and coordinate with departments, ministries and branches to prepare documents to build a Law on participation in the UN peacekeeping force.
Trinh Xuan An, member of the National Assembly's Committee on National Defense and Security, said that the highest document regulating peacekeeping operations at present is Resolution 130 of the National Assembly, which still plays an important role. When drafting this law, the Standing Committee of the National Defense and Security Committee noted the need to closely follow the process and procedures, and soon propose the drafting of a law on participation in the UN peacekeeping force.
Mr. An emphasized the need to clarify the necessity of the law and the existing limitations in implementing current regulations and laws in the implementation of GNQB. The National Defense and Security Committee proposed to closely follow Resolution 130 and include 3-4 basic fundamental policies when drafting the law. Progress should be made so that by April 2024, this draft law will be included in the National Assembly's law-making program, for discussion at the 7th session of the National Assembly (May 2024).
Before giving his opinion on the direction of the draft law, Senior Lieutenant General Hoang Xuan Chien, Deputy Minister of National Defense, announced that on the morning of June 28, President Vo Van Thuong will attend the ceremony to send off the 2.5 field hospital in Ho Chi Minh City.
The Deputy Minister pointed out that the current situation and the process of organizing and implementing the law on peacekeeping operations still reveal a number of difficulties, problems and shortcomings. Vietnam's legal system is incomplete, inconsistent, unsynchronized and has not kept up with the development of the reality of participating in peacekeeping operations at missions.
The Deputy Minister commented that this is an objective factor because Vietnam has only participated for 9 years so it is inevitable that there will be shortcomings.
In addition, there are no specific regulations to regulate some activities according to the mechanisms and requirements of the UN and international organizations. Mr. Chien cited that recently, Vietnam had 2 officers go to the Central African Republic for training at the request of the EU. This is a new issue so it needs to be summarized, supplemented, and completed.
Regarding the lack of uniformity and concentration in national coordination in participating in peacekeeping operations, the Deputy Minister said that the Ministry of National Defense has the Vietnam Peacekeeping Department, the Ministry of Public Security has a permanent office, and when the civilian forces participate, there will be another organization. To overcome this, the Government has assigned research to build a national coordination center for peacekeeping operations.
The Deputy Minister also pointed out the fact that the regime and policies for participants in GGHB have not been met.
Senior Lieutenant General Hoang Xuan Chien assigned the Vietnam Peacekeeping Department to coordinate with the presiding agencies and units to research and absorb opinions to report to competent authorities for consideration and decision on law making.
