What is the penalty for driving below the speed limit?

Decree 100/2019/ND-CP amended by Decree 123/2021/ND-CP stipulates penalties for vehicles driving below the minimum speed.

Accordingly:

Point q, Clause 1, Article 6 of Decree 100/2019/ND-CP stipulates a fine of VND 100,000 to VND 200,000 for driving motorbikes and motorbikes below the minimum speed on roads with prescribed minimum speed limits.

Point d, Clause 2, Article 6 of Decree 100/2019/ND-CP, amended by Point 34, Article 2 of Decree 123/2021/ND-CP, stipulates an administrative fine of VND 300,000 to VND 400,000 for driving a motorbike or scooter at low speed without keeping on the right side of the road, causing traffic obstruction.

For cars, Point b, Clause 2, Article 5 of Decree 100/2019/ND-CP stipulates an administrative fine of VND 400,000 to VND 600,000 for driving a car at a lower speed than a vehicle going in the same direction without going to the right side of the road.

Note: The above violation will be excluding cases where other vehicles going in the same direction exceed the prescribed speed limit.

Point s, Clause 3, Article 5 of Decree 100/2019/ND-CP stipulates administrative fines from VND 800,000 to VND 1,000,000 for driving below the minimum speed on roads with prescribed minimum speed limits.

In addition, Point i, Clause 3, Article 7 of Decree 100/2019/ND-CP stipulates a fine of VND 400,000 to VND 600,000 for driving tractors and specialized motorbikes below the minimum speed on roads with prescribed minimum speed limits.

Minimum speed signs are usually placed in areas that require high speed traffic. This will help vehicles move more smoothly and quickly. If the instructions on this sign are violated, the driver may be fined.

According to Regulation 41:2019/BGTVT, the minimum speed limit sign is denoted as R.306. This sign is circular, has a blue background and in the middle of the sign is a white minimum speed number.

This sign is effective in requiring motor vehicles to operate at a speed not less than the value written on the sign. However, this Regulation emphasizes that this speed is only required in favorable and safe traffic conditions. Thus, when it rains, vehicles participating in traffic will not need to meet the minimum speed. However, even if driving at a lower speed than vehicles going in the same direction, it is still necessary to pay attention to driving on the right side of the road.
