Demanding salary arrears, workers were shocked because the canteen seller was the director.

Workers worry that the company is disposing of assets.

Workers said the factory's name had changed three times, but they only thought the company had changed its name and did not know that the company had also changed owners.

Ms. N. (a worker for 4 years) said the company changed its name three times but the work is still the same, and the salary is still paid regularly. She just started to owe salary at the beginning of this year.

"Everyone thought the economic situation was difficult so they sympathized. Last week, the company suddenly announced that the electricity was cut off so we had to stop working. But we heard that the company was moving all the machines to close down so we went to the factory to demand our wages.

When the government agency came to work, we found out that the company director was not the old director but the person who sold water at the company canteen before," Ms. N. added.

According to a quick report from the Department of Labor, War Invalids and Social Affairs of District 12, Tuan Vinh Production and Trade Company Limited scheduled salary payment on March 25. But when the workers arrived, the director was not present and only the authorized person was there to handle the matter.

Accordingly, the workers requested the company to pay the salary arrears of about 1.3 billion VND. In which, the manager's salary includes a part of the salary for December 2023, the salary for January, February and 20 working days of March 2024; the worker's salary includes the salary for February and 20 working days of March 2024.

At the meeting, the company representative said that they were facing financial difficulties and asked the workers to wait until April 10 to find a partner to come to the factory to get the money to pay their wages. If they could not come to the factory, the company would liquidate its assets to pay the wages.

Contacting Mr. Trinh Xuan Hung (authorized representative of Tuan Vinh Company) on March 25, Mr. Hung said he was in charge of administration and human resources. He was authorized to work with the employees, but the business owner immediately revoked this authorization.

"The company has also owed me about 100 million VND in salary since the end of 2023. I know the company has changed owners, but I still work for a salary under the direction of the board of directors.

We, the workers, now want to take an inventory of our assets to avoid the situation where the company sells everything off and we won't be able to settle our salary debt," said Mr. Hung.

The director is a security guard and canteen vendor.

According to the workers, at first the company was named Ha Nam An 3 (Ha Nam An 3 Garment Production and Trading Company Limited) owned by Mr. Quan Van Phuoc.

After that, the company changed its name to DV Fashion (DV Fashion Garment Production and Trading Company Limited). Most recently, the nameplate was changed to Tuan Vinh Garment Production and Trading Company Limited. However, the work and workplace of the workers remained almost unchanged.

In the file, DV Fashion Company, with Mr. Ho The Xuan as legal representative since December 2023, has the same business registration number as Ha Nam An 3 Company. But the employee said that Mr. Ho The Xuan is only the company's security guard.

Meanwhile, Tuan Vinh Company was newly established according to its business registration license in December 2023. Mr. Le Van Tuan is the company representative, but workers know that he is a water seller at the canteen.

Workers said their social insurance money was still deducted but they did not pay it to the social insurance agency. They asked the company to pay their salary and insurance debt from the end of 2022 until now.

On March 29, the company representative worked with the labor mediator and the employees about unpaid wages and social insurance. However, they are still in the process of collecting information from the employees to come up with a solution.

"We just hope to get our salary back to pay rent, take care of our children and close our social insurance books to find new jobs.

But if the company tries to sell all the machines and disperse assets during the settlement period, how will we workers receive the money?" Ms. LTH worried.
