Guidance on the arrangement and assignment of non-professional staff when implementing two-level local government

(Chinhphu.vn) - Minister of Home Affairs Pham Thi Thanh Tra, Deputy Head of the Government's Steering Committee for the arrangement of administrative units at all levels and the construction of a two-level local government organization model, has just signed Official Dispatch No. 12/CV-BCĐ to the Provincial Party Committee, City Party Committee, and People's Committee of the province and centrally-run cities on guiding a number of contents for non-professional workers at the commune level when implementing the two-level local government model.

The dispatch stated that, based on Conclusion 163-KL/TW of 2025 of the Politburo and Secretariat, which requires "studying a roadmap to extend the use of non-professional people in accordance with the time of rearranging villages and residential groups (before May 31, 2026)", the Steering Committee for rearranging administrative units at all levels and building a 2-level local government organization model of the Government oriented a number of specific contents.

Accordingly, the Steering Committee recommends that localities, based on the practical situation and the requirements for performing the tasks of the political system at the new commune level, temporarily arrange to extend the use of non-professional workers at the commune level until before May 31, 2026. If necessary, the People's Committee at the commune level can arrange and assign non-professional workers to the position of non-professional workers in villages and residential groups.

In case the local Party Committee and government in the new commune-level administrative unit do not need to continue using part-time workers at the commune level, they shall implement the settlement of regimes and policies according to the provisions of Decree 154/2025/ND-CP dated June 15, 2025 of the Government regulating staff streamlining.

In case a non-professional worker at the commune level wishes to retire immediately from the implementation of the 2-level local government model, he/she will enjoy the regime and policies according to the provisions of Decree 154/2025/ND-CP.

In case the local Party Committee and government at the commune level have a need to use and the non-professional workers at the old commune level wish to continue working, the local Party Committee and government shall consider and temporarily arrange them to positions to support the work of the political system of the new commune-level administrative unit (Party agencies, the Fatherland Front and socio-political organizations, local authorities) or to participate in the positions of non-professional workers in villages and residential groups until before May 31, 2026 and continue to enjoy allowances, regimes and policies issued by the Provincial People's Council (Resolutions of the Provincial People's Council issued according to the provisions of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups).

During this time, if a part-time worker at the commune level quits his/her job, he/she will enjoy the regime and policies prescribed in Decree 154/2025/ND-CP.

During the implementation process, if there are any difficulties or problems, the People's Committees of provinces and centrally-run cities are requested to promptly report to the Ministry of Home Affairs for synthesis and reporting to competent authorities for consideration and decision.
