Bauxite mining faces difficulties due to illegal cultivation

Lam Dong Aluminum Company Limited (abbreviated as Lam Dong Aluminum Company) was assigned by Vietnam National Coal - Mineral Industries Group to exploit bauxite ore at the bauxite mine located west of Tan Rai Aluminum Factory (Bao Lam 1 commune, Lam Dong province) to serve aluminum production. Currently, the company is facing difficulties in implementing the Lam Dong Bauxite - Aluminum Complex project due to illegal planting by local people.

According to Mr. Nguyen Van Phong - Director of Lam Dong Aluminum Company, the Tay Tan Rai bauxite mine area has more than 181 hectares of land belonging to the Dam Bri Protective Forest Management Board and Vinh Loc Seed Company Limited. On May 27, 2025, the People's Committee of Bao Lam district (old) issued Decision No. 1428/QD-UBND, followed by Decision No. 1867/QD-UBND on June 24, 2025 to reclaim 36.27 hectares (first time) of land from the Dam Bri Protective Forest Management Board and hand it over to Lam Dong Aluminum Company to implement the bauxite mining project (part within the scope of the mine license). This is a part of the area previously recovered by Lam Dong Provincial People's Committee from Vinh Tien Company Limited's land in Bao Lam district (145.65 ha) to be handed over to Dam Bri Protective Forest Management Board for management in Decision No. 726/QD-UBND dated April 10, 2025 (including 118.12 ha within the scope of the mining license) due to the termination of Vinh Tien Company Limited's project activities. Therefore, the State does not compensate for land and assets attached to the land according to regulations.

As for Vinh Loc Seed Company Limited, the State leased 95.34 hectares of land, of which 85.90 hectares are within the mining license boundary. Up to now, in addition to the 1.14 hectares that have been decided to reclaim and hand over land, Lam Dong Aluminum Company is preparing to receive the site with an area of ​​14.55 hectares recovered by the People's Committee of Bao Lam district in Decision No. 2006/QD-UBND dated June 27, 2025. The compensation and support cost for Vinh Loc Seed Company Limited is 0 VND, approved in Decision No. 1866/QD-UBND dated June 24, 2025 of the People's Committee of Bao Lam district because there is not enough basis for compensation and support because the crops and assets on the land were established incorrectly compared to the investment certificate. Vinh Loc Seed Company Limited also failed to provide relevant documents and records to prove the change in land use purpose.

According to Mr. Nguyen Van Phong, previously, the entire land area assigned by the State to the Dam Bri Protective Forest Management Board and Vinh Loc Seed Company Limited was for planting production forests. During the process of managing and implementing production forest planting, Vinh Loc Seed Company Limited transferred the rights to the people, leading to a change in the current status of the trees planted on the land area. "Currently, the coffee trees cultivated by the people (encroaching on forest land, illegally receiving cultivation rights) are at the age of harvest. Therefore, we consider that bringing in equipment to level and exploit ore will be difficult, because of the people's opposition," said Mr. Nguyen Van Phong.

According to the leader of Bao Lam 1 Commune People's Committee, Bao Lam 1 Commune People's Committee has repeatedly explained to the people that it is illegal for people to grow coffee on land planned for bauxite mining. However, the coffee growing households here claim that they have a franchise contract with Vinh Loc Seed Company Limited. In directing the resolution of the above issue, Mr. Le Trong Yen - Vice Chairman of the Provincial People's Committee, requested Lam Dong Aluminum Company, Bao Lam 1 Commune and related departments, branches and units of Lam Dong Province to clearly explain to the people growing coffee on land planned for bauxite mining that the franchise contract between the people and Vinh Loc Seed Company Limited is a civil contract, between the people and the company, the responsibility to resolve related issues belongs to Vinh Loc Seed Company Limited.

Vice Chairman of the Provincial People's Committee Le Trong Yen further noted that departments, branches, units and the People's Committee of Bao Lam 1 commune, based on current legal regulations, should promptly support Lam Dong Aluminum Company, creating favorable conditions for the unit to carry out the project.
