- You should not set a password that is too easy such as your date of birth or ID number because then it will be easy for thieves to find out the password if you lose your wallet. Absolutely avoid leaving your password and card information in the same wallet, because if you lose your wallet, it means you will lose all the money in your account.

- When withdrawing money at an ATM, you must observe carefully to see if there is a camera cleverly installed by bad guys to record your password and card information.

- You should cover the keyboard when entering your PIN and absolutely do not ask strangers to withdraw money for you, because while withdrawing, they may secretly transfer your money to another account, or get hold of your password.

- Count the money to avoid the case of the machine giving out less money or the machine swallowing the money. Whether withdrawing a lot or a little, you should still choose to print a receipt or print an invoice because this is the form that guarantees the transaction. If there is an error or mistake, you just need to take the form to the card-issuing bank so they can look it up.

- Always get the card first and then put it in your wallet for safety. To avoid the machine swallowing your card, you should take the card before taking the money. Nowadays, most ATMs release the card first, then the money.

- When withdrawing money, if you wait for a long time but the ATM does not release the money or card. You should patiently wait for the result notification on the ATM screen and only leave the ATM when you know the transaction status and the ATM screen returns to normal .

- If you accidentally lose your card, or discover that your account has been stolen. You must immediately call the bank's hotline to block the card. If you discover that money has been stolen, in addition to reporting to the bank, you must immediately report to the police for investigation to clarify.

How to deal with withdrawing money from an ATM card you found without permission?

Talking to Dan Tri, lawyer Tran Viet Ha analyzed that the above behavior will be prosecuted for the crime of property theft as stipulated in Article 172 of the Penal Code. Even if the credit card falls out and is picked up by someone, the person who picked it up did not secretly steal the card, but the person who picked it up and spent the money in the card will be prosecuted for the crime of Openly appropriating property.

According to lawyer Ha, the credit card fell by itself but inside it was hidden property. When the person who picked up the card had brazenly used the card. The real owner of the credit card had the money in the card secretly taken by someone else. That is the crime of property theft.

"In this case, appropriating an amount of money from 2,000,000 to 50,000,000 VND, the penalty is 3 years of non-custodial reform or 6 months to 3 years of imprisonment," lawyer Ha affirmed.

The crime of open appropriation of property is an act that directly lets the property owner see the act of appropriating property without the property owner being able to do anything. The crime of open appropriation of property is regulated in Article 172 of the Penal Code.

Not only with credit cards, in cases of transferring money to the wrong account number, the recipient of that amount can also be prosecuted criminally. Because according to lawyer Ha, point D, clause 2, article 15 of Decree 144/2021 on illegal possession of property, the recipient who spends less than 10 million VND can be fined 3-5 million VND.

More seriously, if the amount is over 10 million VND, according to this lawyer, the recipient may be prosecuted for the crime of illegal possession of property under Article 176 of Decree 144/2021. Accordingly, anyone who intentionally fails to return money to the owner, legal manager or fails to hand over to the responsible agency property worth from 10,000,000 to 200,000,000 VND will be fined from 10,000,000 to 50,000,000 VND. In addition, the recipient may be subject to non-custodial reform for up to 2 years, or imprisonment from 3 months to 2 years.

Even the crime of appropriating property worth 200,000,000 VND or more can be punished with 1-5 years in prison.

Article 172. Crime of open appropriation of property

Anyone who openly appropriates another person's property worth from VND 2,000,000 to under VND 50,000,000, or under VND 2,000,000 but falling into one of the following cases, shall be subject to non-custodial reform for up to 3 years or imprisonment from 6 months to 3 years:

a) Having been administratively sanctioned for property appropriation but still committing the violation;

b) Having been convicted of this crime or one of the crimes specified in Articles 168, 169, 170, 171, 173, 174, 175 and 290 of this Code, not yet had the criminal record cleared, and still committing the violation;

c) Adversely affecting social security, order and safety;

d) The property is the primary means of livelihood of the victim and their family.
