I quit my job for 3 years and lost my social insurance book. Can I withdraw my social insurance at once?

Ms. Tran Thi Hong Duyen participated in social insurance from the end of 2020 until August 2021, then quit her job and stopped participating in social insurance. After quitting her job, Ms. Duyen received unemployment benefits but has not withdrawn her social insurance.

Duyen asked: "I have lost my social insurance book and want to withdraw my social insurance at once. Am I eligible to withdraw my social insurance at once?"

According to Vietnam Social Security, the conditions for receiving one-time social insurance are specified in detail in Clause 1, Article 8 of Decree No. 115/2015/ND-CP and Article 4 of Circular No. 56/2017/TT-BYT (amended in Article 1 of Circular No. 18/2022/TT-BYT). Accordingly, employees who have a request are entitled to receive one-time social insurance if they fall into one of the following four cases.

Firstly, workers who are old enough to receive pensions according to regulations but have not paid social insurance for 20 years. Female workers who are full-time or part-time workers in communes, wards and towns participate in social insurance when they retire without paying social insurance for 15 years and do not continue to participate in voluntary social insurance.

Second, employees who quit their jobs after one year without paying social insurance for 20 years and do not continue to pay social insurance.

Third, workers go abroad to settle down.

Fourth, workers who are suffering from one of the life-threatening diseases such as cancer, paralysis, cirrhosis, leprosy, severe tuberculosis, HIV infection that has progressed to AIDS; people with diseases or disabilities that reduce their working capacity by 81% or more and cannot control or perform daily personal activities without being monitored, assisted, and fully cared for.

Based on the above regulations, Ms. Duyen belongs to the second case. To receive one-time social insurance benefits, Ms. Duyen can submit an application to the local social insurance agency where she lives.

The one-time social insurance benefit application includes the social insurance book. Currently, Ms. Duyen has lost her book, so she must go to the local social insurance agency to apply for a new social insurance book before applying for a one-time social insurance benefit.

Procedures for re-issuing social insurance books due to loss, damage, or merging social insurance books are specified in Clause 1, Article 27 of Consolidated Document No. 922/VBHN-BHXH dated April 5, 2023 of Vietnam Social Security.
