In Official Dispatch 7707/BNV-TCBC sent to the Department of Home Affairs of Bac Ninh province, the Ministry of Home Affairs provides specific instructions on resolving a number of difficulties and problems when implementing Decree 154/2025/ND-CP on streamlining staff.

Regarding the signing of labor contracts after enjoying the regime and policies under Decree 154/2025/ND-CP, the Ministry of Home Affairs said that Decree 154/2025/ND-CP stipulates that if the subjects of staff streamlining are elected, re-recruited into agencies, organizations, units receiving salaries from the state budget or arranged to work as part-time workers in villages and residential groups within 60 months from the date of staff streamlining, they must return the subsidy amount received to the agency, organization, or unit that paid the subsidy.
Accordingly, in the case of non-professional workers at the commune level who have enjoyed policies and regimes under Decree 154/2025/ND-CP, they are allowed to sign labor contracts in other job positions (such as clerks, drivers, janitors) and do not have to return the subsidy amount received to the agency, organization, or unit that paid the subsidy according to the provisions of Clause 6, Article 3 of this document.
Thus, part-time workers at the commune level who have signed labor contracts to work as clerks, drivers, and janitors will not have to repay the downsizing allowance.
Decree 154 stipulates that part-time workers at the commune level who have not reached the prescribed retirement age are entitled to the following benefits:
Firstly, the group with less than 5 years of work experience will receive a one-time allowance equal to 0.8 times the current monthly allowance multiplied by the number of months of work.
This group is also entitled to a subsidy equal to 1.5 times the current monthly allowance for each year of work; a subsidy of 3 months of the current monthly allowance to find a job and reserve the compulsory social insurance payment period or receive a one-time social insurance payment according to the provisions of the law on social insurance.
Second, people with 5 years of work experience or more and less than 5 years of retirement age are entitled to a one-time allowance equal to 0.8 times the current monthly allowance multiplied by the number of months of early retirement compared to retirement age.
This group continues to receive a subsidy equal to 1.5 times the current monthly allowance for each year of work; receives a subsidy of 3 months of the current monthly allowance to find a job and also reserves the time to pay compulsory social insurance or receive a one-time social insurance payment according to the provisions of the law on social insurance.
Third, people who have worked for at least 5 years and have at least 5 years left until retirement age are entitled to a one-time allowance equal to 0.8 times the current monthly allowance multiplied by 60 months.
This group is also entitled to a subsidy equal to 1.5 times the current monthly allowance for each year of work; a subsidy of 3 months of the current monthly allowance to find a job; and a reservation of compulsory social insurance payment time or a one-time social insurance payment according to the provisions of the law on social insurance.
In addition, commune-level cadres and civil servants who are reorganized into commune-level administrative units in the 2023-2025 period, if they are assigned to work as part-time commune-level workers, will enjoy the same benefits as prescribed above, but the current monthly salary used to calculate the allowance is the salary of the previous month of the position of commune-level cadres and civil servants before being assigned to work as part-time workers at the commune level.
On the other hand, non-professional workers at the commune level who have reached the prescribed retirement age or are receiving pension or disability benefits are entitled to a one-time allowance equal to 15 months of the current monthly allowance.
