Many contents of the implementation of the Capital Law issued before January 1, 2025

Accordingly, the content of the detailed regulations of the 2024 Capital Law under the authority of the Government has 6 contents (of which: 3 contents need to be issued before January 1, 2025; 3 contents need to be issued before July 1, 2025).

The detailed provisions of the Law under the authority of the City People's Council have 32 contents (of which: 28 contents need to be issued before January 1, 2025; 4 contents need to be issued before July 1, 2025). The detailed provisions of the Law under the authority of the City People's Committee have 11 contents, need to be issued before January 1, 2025.

For the content requiring the issuance of legal documents under the authority of the Government: the assigned departments and branches shall urgently advise on the drafting of documents of the City People's Committee to request relevant ministries and Government agencies to coordinate in organizing implementation.

For the content requiring the issuance of legal documents under the authority of the city: the departments, branches and sectors assigned to preside over the drafting of documents shall proactively develop implementation plans and promptly advise on the drafting of documents according to the order and procedures prescribed in the Law on Promulgation of Legal Documents and submit them to competent authorities for promulgation. In particular, focus resources on prioritizing the drafting of detailed regulations to be issued and take effect at the same time as the 2024 Capital Law takes effect (January 1, 2025).

For the contents that take effect from July 1, 2025, which are complicated, it is necessary to conduct careful research and develop documents, and submit them to competent authorities for promulgation in the first and second quarters of 2025.

The development of detailed regulations must be determined according to the assigned content that is related to each other or has similar nature in scope and field to be developed and promulgated in a legal document, ensuring convenience and consistency for the process of implementing the Law and detailed regulations.

The Department of Justice is responsible for presiding over and coordinating with the departments, branches and sectors assigned to compile a list of legal documents under the authority of the People's Council and People's Committee of the City to submit to competent authorities for consideration and decision in July 2024.

Regarding legal documents issued to exercise the authority assigned in the Capital Law 2024: There are 21 contents under the authority of the City People's Council. There are 4 contents under the authority of the City People's Committee. There is 1 content under the authority of the District and Town People's Council.

In this regard, the departments, branches and sectors assigned to preside over the drafting of documents shall proactively develop implementation plans, focus on reviewing, researching and proposing key, key, necessary contents that can be implemented immediately for early promulgation, taking effect together with the enforcement of the Capital Law. For contents that still need to be researched, evaluated, ensuring practical conditions, implementation resources, and social consensus, they shall be implemented cautiously and firmly, and propose promulgation after fully assessing relevant factors, suitable for implementation.

Previously, on June 28, 2024, at the 7th Session, the 15th National Assembly passed the Law on the Capital (Law No. 39/2024/QH15). The Law takes effect from January 1, 2025 (of which 5 contents take effect from July 1, 2025).
