Faced with changes in the content and methods of education and training today, many regulations on the working regime of general and pre-university teachers are no longer suitable. In order to ensure the rights of teachers in the new context, the Ministry of Education and Training has developed a Circular regulating the working regime for general and pre-university teachers.
The new Circular, when issued, will replace Circular No. 28/2009/TT-BGDDT and Circular No. 15/2017/TT-BGDDT, and is the legal basis for educational institutions to effectively carry out the assignment, arrangement, and use of teachers from 2009 to present.
The draft Circular has a number of new regulations and adjustments compared to the current Circulars, such as: Teachers' working time is implemented according to the school year , converted into teaching periods in 01 school year or average teaching periods in 01 week to give schools flexibility in assigning and arranging teachers to implement the 2018 General Education Program and facilitate the calculation of overtime pay. In case teachers have to be assigned to teach more than the average teaching period norm in 01 week (including converted teaching periods for concurrent tasks), the number of teaching periods exceeding the norm must not be greater than 25% of the average teaching period norm in 01 week to ensure teachers' work efficiency and ensure regulations on overtime in the Labor Code.

The new draft Circular also stipulates a unified number of actual teaching weeks for teaching educational content in the general education program of 35 weeks to ensure compliance with the regulations in the 2018 General Education Program and the guidance of the Ministry of Education and Training on the school year time frame.
Regulations stipulate that teachers teaching in general schools with many levels of education are appointed to the professional title of teacher at which level of education, then implement the prescribed teaching period norms for teachers at that level of education and 01 assigned teaching period is calculated as 01 standard period to unify the teaching period norms for teachers in general schools with many levels of education and in accordance with the current trend of rearranging general schools.
It is stipulated that each teacher shall not hold more than 02 concurrent tasks (including concurrent professional work; concurrently holding positions in the Party, mass organizations and other organizations; concurrently holding other job positions) to ensure that teachers focus on teaching and education tasks.
Regulations stipulate that concurrent tasks that have received remuneration or allowances must not have their teaching hours reduced and cannot be converted into teaching hours (except for concurrent tasks of trade union work, youth union secretary, and deputy youth union secretary at the school level) to avoid duplicate payment of regimes and policies for the same task.
Regulations on cases where maternity leave (for female teachers) coincides with summer vacation to ensure teachers' rights and resolve teachers' difficulties in the past. In cases where female teachers have maternity leave that coincides with the annual summer vacation and the remaining annual summer vacation (if any) is less than the annual vacation as prescribed by the Labor Code, the teacher will be arranged to take additional days off to ensure that the total number of days off is equal to the number of annual vacation days as prescribed by the Labor Code.
Additional cases that do not require make-up teaching and are counted as having taught the full number of assigned periods include cases where teachers are absent for medical examination or treatment (not exceeding the prescribed time) with the consent of the school principal and have confirmation of medical examination or treatment from a medical facility.
Regulate the number of teaching periods for teachers working as General Managers of Ho Chi Minh Young Pioneers into 02 levels according to class size (equivalent to the current teaching period norms of first-class and second-class schools) and specifically regulate the number of standard periods instead of regulating the ratio of standard periods/week of the corresponding grade level and according to each school class as currently.
Increase the number of periods for homeroom teachers at primary level to 4 periods/week like homeroom teachers at secondary and high school levels to ensure consistency with the duties of homeroom teachers and consistency between levels.
Clarify the method of calculating the reduction of teaching hours for teachers who also work as student counselors ; teachers who also work as group leaders or deputy group leaders of student management groups; teachers who also work as clerical, office administration, and library staff.
Supplementing regulations on reducing teaching hours in cases where teachers teach online; teaching Vietnamese to ethnic minority children before entering first grade; participating in training excellent students, training students to participate in Phu Dong sports festival, guiding students to participate in science and technology competitions, guiding students to participate in student competitions with startup ideas; serving as a judge in school-level teacher competitions or competitions (competitions or competitions according to regulations of the Ministry of Education and Training).

In general, the draft Circular has overcome difficulties and obstacles in implementing regulations on working regimes for general education teachers in the past time, creating favorable conditions for educational institutions in assigning, arranging and using teachers.
