New regulations of the Politburo, identifying acts of seeking positions and power

The Politburo 's regulations on controlling power and preventing corruption and negativity in personnel work clearly state acts of taking advantage of and abusing positions and powers in personnel work; acts of seeking positions and power.

Fighting negativity in personnel work

On behalf of the Politburo, Politburo member and Permanent Secretary of the Secretariat Truong Thi Mai signed Regulation 114 on controlling power, preventing and combating corruption and negativity in personnel work.

With 15 articles, Regulation 114 stipulates corruption and negative behavior in personnel work; responsibility for controlling power and preventing corruption and negative behavior in personnel work and handling violations.

This regulation clearly stipulates acts of taking advantage of and abusing positions and powers in personnel work, including:

Using one's own prestige and influence and that of family members to suggest, influence, and pressure others to decide, direct, advise, propose, comment, evaluate, vote, take a vote of confidence, vote to recommend personnel, or vote according to one's will.

Allowing relatives and close friends to take advantage of their positions, powers, and prestige to influence, manipulate, and interfere in all stages of personnel work.

Integrating personal intentions when performing stages of personnel work for personal gain or benefit to personnel in the process of performing this work.

Directing and advising on all stages of personnel work regarding unqualified personnel; not in accordance with principles, regulations, processes, rules and decisions.

Delay, do not perform when it is disadvantageous or choose a time that is beneficial to the staff to carry out the personnel work process.

When receiving a petition, letter of reflection, denunciation or knowing that a staff member has committed corrupt or negative acts in personnel work but compromises, tolerates, covers up, does not handle it according to authority, handles it not in accordance with regulations or does not report to the competent authority for handling...

Confirming, certifying, commenting, or evaluating in an imposing manner, not true in nature, not true, or falsifying or distorting the content of personnel records, election results, taking recommendation votes, votes of confidence, recruitment, or examinations to benefit personnel or to achieve personal goals.

Providing or disclosing information, documents, and records of cadres and party members to organizations and individuals without authority or responsibility, especially information, documents, and personnel records in the process of implementing cadre work procedures.

Clearly identify acts of seeking positions and power

Regulation 114 also clearly stipulates acts of seeking positions and power, specifically including:

Directly or indirectly brokering, giving and receiving bribes to help others obtain positions, titles, and benefits.

Giving gifts, money, real estate or other material or non-material benefits, arranging entertainment activities for people in authority or responsibility with the aim of gaining support, trust, position, title or benefits.

Running after age, seniority, emulation title, reward, degree, assignment, appointment, introduction, candidacy, designation, transfer, rotation, secondment, conferment, promotion in military rank... with the aim of meeting standards, conditions, obtaining position and benefits.

Taking advantage of familiar relationships or using the advantages, work position, and prestige of others to influence, gain advantage, and put pressure on people with authority and responsibility in order to obtain a position, title, or benefits...

Other negative behaviors such as meeting, contacting, and exchanging with personnel against regulations during the process of performing personnel work. Harassing, causing difficulties, troubles, prolonging time, setting conditions with personnel and personnel submitting agencies...

Regulation 114 also emphasizes not to arrange for people with family relationships to simultaneously hold related positions such as members of the same standing committee of the Party Committee, Party executive committee, Party delegation, or collective leadership of the agency or unit.

The head and deputy head of the same locality, agency, or unit. The head of the Party committee or administrative agency and the head of agencies such as the interior, inspection, finance, banking, tax, customs, industry and trade, investment planning, natural resources and environment, military, police, court, procuracy at the central level or provided in a locality.

In case there is no personnel plan that meets the requirements and the personnel is a highly trusted family member, it must be reported to and approved by the immediate superior Party Committee before being arranged.

Positions under the management of Party committees and organizations directly under the Central Committee must report to the Central Organizing Committee; positions under the Central Committee's management must report to the Central Organizing Committee to report to competent authorities.

The regulation clearly states that if cadres, party members, civil servants and public employees violate the regulations, competent authorities will consider and handle them according to regulations. Competent authorities will also consider and apply handling measures according to regulations.

This regulation replaces Regulation 205/2019 of the Politburo on controlling power in personnel work and preventing the abuse of power and position.
