Creating a solid legal corridor for crime prevention and combat

Presenting the Report on some major issues on the draft Law on Management and Use of Weapons, Explosives and Support Tools (amended), Lieutenant General Le Tan Toi, Chairman of the National Assembly's Committee on National Defense and Security, stated that the Law on Management and Use of Weapons, Explosives and Support Tools 2017 was amended to strengthen the management and use of weapons, explosives and support tools; reform administrative procedures, reduce unnecessary paperwork to ensure compliance with reality, create favorable conditions for agencies, organizations and people; create a solid legal corridor in state management and prevent and fight against crime.

Regarding the declaration of primitive weapons (Article 32, draft Law), the Chairman of the National Defense and Security Committee said that primitive weapons are special means, directly related to human life and health and the work of ensuring security and order, and need to be strictly managed. In the display and exhibition activities, heirlooms have primitive weapons that are still capable of causing damage; currently, many museums have a very large number of artifacts. Therefore, the regulation on declaring primitive weapons is necessary for strict management, as a basis for verification and determination of responsibility when violations occur. Therefore, the Standing Committee of the National Defense and Security Committee proposed that the National Assembly Standing Committee keep this regulation as the draft Law submitted by the Government .

However, taking into account the opinions of National Assembly deputies, the Standing Committee of the National Defense and Security Committee has revised the name of Article 32 to "Declaration of primitive weapons used as exhibits for display, exhibition, and heirlooms"; at the same time, adding a provision limiting the declaration to only "primitive weapons specified in Point a, Clause 4, Article 3" as accepted and revised in the draft Law.

Preventing the use of highly lethal knives for illegal purposes

Through discussion, members of the National Assembly Standing Committee basically agreed with the draft Law on Management and Use of Weapons, Explosives and Support Tools (amended) which has been revised on the basis of absorbing the discussion opinions of National Assembly deputies in groups and halls; affirmed that the drafting agency and the verification agency have fully absorbed the comments and fully explained the opinions.

Reporting at the meeting, Deputy Minister Le Quoc Hung said that the drafting agency highly agreed with the report of reception and explanation of the National Defense and Security Committee and the opinions of the delegates, and will fully absorb the opinions of the delegates to supplement and revise the Law project to be strict, scientific , and effectively serve the work of preventing and fighting crime before submitting it to the National Assembly for approval.

Regarding the regulation on knives with high lethality, Deputy Minister Le Quoc Hung said that this regulation has been revised in the draft Law in the direction that knives with high lethality are clearly defined in relation to the purpose of use. "If used for daily labor, production and business purposes, they are not weapons. However, Clause 1, Article 32a stipulates that organizations and individuals trading, exporting - importing, using and transporting knives with high lethality must implement safety measures" - Deputy Minister Le Quoc Hung emphasized and said that the Government will prescribe safety measures for the activities of production, trading, exporting - importing, using, transporting or carrying knives with high lethality. This regulation is to strictly manage the production, trading, exporting - importing, using and transporting of this type of primitive weapon. At the same time, it prevents the risk of using knives with high lethality for illegal purposes. "We have been consistent with this viewpoint throughout the process of building the Law up to now" - Deputy Minister Le Quoc Hung affirmed.

The draft Law is eligible to be submitted to the National Assembly for consideration and approval at the 7th Session.

Concluding the session, Vice Chairman of the National Assembly Tran Quang Phuong said that the National Assembly Standing Committee highly appreciated the preparation of the Government, the Drafting Agency, and the Review Agency. Through discussion, the National Assembly Standing Committee basically agreed with the draft Law on Management and Use of Weapons, Explosives and Support Tools (amended) which was revised based on discussions of National Assembly deputies in groups and the hall; basically agreed with the draft, as well as the report on explanation, acceptance, and revision.

Vice Chairman of the National Assembly Tran Quang Phuong emphasized that this is a difficult Law, although there are not many amendments, the content is very difficult to design in legislative techniques. Although the Law was passed under the one-session process, the Government has also directed careful preparation and research, because it is related to human rights and civil rights. The National Assembly Standing Committee also highly appreciated the preparation of the Government, the Drafting Agency, the Agency in charge of the review, and so far has basically ensured that it will be submitted to the National Assembly for approval at the 7th Session.

The Vice Chairman of the National Assembly said that the National Assembly Standing Committee agreed to assign the Judiciary Committee to preside over and coordinate with the Law Committee, the National Defense and Security Committee, and other agencies to review the content of high-damage knives to ensure consistency with the Penal Code. At the same time, he requested the Government to direct the Ministry of Public Security to coordinate with media agencies to propagate the process of drafting the law, new contents, the process of receiving, revising, and perfecting the draft law, carefully assessing the impact; completing the convincing Explanation and Acceptance Report; promptly developing and promulgating a decree guiding the implementation of the law... "Propagate well the process of drafting the law, the process of receiving, revising, and perfecting the draft law to increase people's consensus" - the Vice Chairman of the National Assembly emphasized.

Vice Chairman of the National Assembly Tran Quang Phuong delivered concluding remarks at the meeting.


The Vice Chairman of the National Assembly also requested that the National Defense and Security Committee preside over and coordinate with the Drafting Committee and relevant agencies to receive comments at the meeting; coordinate with the Judiciary Committee and other agencies to invest efforts to clarify issues related to the Penal Code, as well as complete the draft Law and report on explanations, reception, ensuring objectivity and high persuasiveness. After that, send it back to the National Assembly Standing Committee for comments in writing as directed by the Chairman of the National Assembly; send it back to the National Assembly deputies as prescribed to ensure approval at the end of the second meeting of this 7th Session.
