When is the land price calculated?
At the press conference, media agencies were interested in a number of contents such as the impact of Decision 79 on people and businesses when applied as well as information about transitional provisions.
Accordingly, Decision 79 takes effect from October 31, 2024 to December 31, 2025. From now until the Decision takes effect, how will people's financial and tax obligations be fulfilled?
Responding, Mr. Nguyen Toan Thang, Director of the Department of Natural Resources and Environment, said that Decision No. 79/2024/QD-UBND clearly stipulates the time of applying the land price list to calculate land use fees.
Specifically, if people submit complete documents to the one-stop department at a certain time, taxes and financial obligations will be calculated from that time:
“The time is calculated as the time for submission at the district one-stop office, not the time for the dossier to be transferred to the tax authority. For example, the time for submission at the district one-stop office is calculated at that time. The 2-3 day transfer is an internal matter of state agencies. We take the date the tax authority receives the transferred dossier as that time. The transition content is clearly regulated,” said the Director of the Department of Natural Resources and Environment.
Avoid letting land rent become a burden for businesses
Mr. Nguyen Ngoc Thao, Deputy Director of the City Department of Finance, informed about land rental prices. Accordingly, land rental is calculated at the lowest percentage of 0.25%, the highest is 3% according to the city's announced land price list depending on the purpose of land use.
Currently, the City People's Committee is directing the Department of Finance to consult with departments, branches, and districts on the applicable rate. At the meetings, there were many opinions on applying the land rental rate to the land price list from the perspective of "avoiding affecting the input costs of production industries".
“The city has planned and adjusted the specific land price list so that when applying the price to land for production and business purposes, it will be at 0.5%. This is a stable level, avoiding impacts and fluctuations on input costs of enterprises in order to create favorable conditions for the development of production and business in the city,” Mr. Thao added.
Concluding the press conference, Vice Chairman of the Ho Chi Minh City People's Committee Bui Xuan Cuong said that adjusting the land price list is an important and sensitive issue, affecting many organizations and individuals. The spirit of the city's land price list is to gradually approach market prices, avoiding congestion in the process of handling documents... The implementation of Ho Chi Minh City is extremely cautious, limiting the impact on the legitimate interests of the people.
In the coming time, the city will continue to strengthen propaganda work, be transparent, specific, and thorough, ensuring stability and development; creating consensus among people and businesses.
“After December 31, 2025, that is, from January 1, 2026, Ho Chi Minh City must apply the land price list, the first land price list according to the 2024 Land Law, with the spirit of being completely fair according to market prices during the implementation process. This is a step for us to shift and focus, on the one hand on developing the city, on the other hand on preparing to build a land price list in accordance with the spirit of the 2024 Land Law,” said Mr. Bui Xuan Cuong.
On the morning of October 22, the People's Committee of Ho Chi Minh City officially announced Decision 79/2024/QD-UBND on amending and supplementing Decision No. 02/2020/QD-UBND dated January 16, 2020 of the People's Committee of the City regulating the land price list in the area. This Decision takes effect from October 31, 2024 to December 31, 2025.
