Time to calculate seniority of teachers?

I am a teacher, holding the title of theoretical vocational education lecturer, code V.09.02.03. Due to organizational and unit restructuring, I was transferred to the equivalent rank of specialist in the same vocational education institution, code 01.003.

After that, due to work requirements, I was transferred to a work unit and continued to be appointed to the rank and professional title of theoretical vocational education lecturer (V.09.02.03). I would like to ask, during the time I held the rank of specialist, code 01.003, will I be included in the time to calculate the seniority of a teacher? Nguyen Thu Hien (thuhien***@gmail.com)

The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2020/ND-CP dated August 1, 2021. Accordingly, Clause 1, Article 3 of this Decree stipulates that the period for calculating seniority allowance is determined by the sum of the following periods: Teaching and education time with compulsory social insurance payment in public educational institutions;

Teaching and education time with compulsory social insurance contributions in non-public educational institutions (for teachers currently teaching and educating in public educational institutions who previously taught and educated in non-public educational institutions).

Working time is calculated for seniority allowance, including: Working time is ranked according to one of the ranks or titles of the customs, court, prosecution, audit, inspection, civil judgment enforcement, forestry, national reserve, party inspection; working time is calculated for seniority allowance in the army, police, cryptography and working time is calculated for seniority in other industries and professions (if any).

The period of military service as prescribed by law that is before military service is being counted as seniority allowance.

Subjects of application include teachers who are teaching and educating in public educational institutions that have been transferred and classified according to Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary regime for cadres, civil servants, public employees and armed forces. Based on the above regulations, the time holding the specialist rank (01.003) is not counted in the time of receiving seniority allowance for teachers.
